| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 4101.052, Insurance Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (a) and adding Subsections (c) and (d) to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsection (c), an [An] applicant |
|---|
| 13 | 13 | | for a license under this chapter must submit to the department an |
|---|
| 14 | 14 | | application on a form prescribed and provided by the department, |
|---|
| 15 | 15 | | and include as part of or in connection with the application any |
|---|
| 16 | 16 | | information that the department reasonably requires, including |
|---|
| 17 | 17 | | information about the applicant's: |
|---|
| 18 | 18 | | (1) identity; |
|---|
| 19 | 19 | | (2) personal history; |
|---|
| 20 | 20 | | (3) experience; and |
|---|
| 21 | 21 | | (4) business record. |
|---|
| 22 | 22 | | (c) For the purpose of Subsection (a), the commissioner |
|---|
| 23 | 23 | | shall allow an individual to apply for a license electronically |
|---|
| 24 | 24 | | using the National Association of Insurance Commissioners Uniform |
|---|
| 25 | 25 | | Application for Individual Adjuster or Apprentice |
|---|
| 26 | 26 | | License/Registration as it existed on May 1, 2023. |
|---|
| 27 | 27 | | (d) The commissioner shall take any action necessary for |
|---|
| 28 | 28 | | this state to participate in and adopt the application procedures |
|---|
| 29 | 29 | | of the National Association of Insurance Commissioners National |
|---|
| 30 | 30 | | Insurance Producer Registry for the purpose of licensing and |
|---|
| 31 | 31 | | license renewal for independent adjusters. |
|---|
| 32 | 32 | | SECTION 2. Not later than September 1, 2024, the |
|---|
| 33 | 33 | | commissioner of insurance shall adopt rules to implement Section |
|---|
| 34 | 34 | | 4101.052(d), Insurance Code, as added by this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
