55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to insurance adjuster license application procedures.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 4101.052, Insurance Code, is amended by
1010 amending Subsection (a) and adding Subsections (c) and (d) to read
1111 as follows:
1212 (a) Except as provided by Subsection (c), an [An] applicant
1313 for a license under this chapter must submit to the department an
1414 application on a form prescribed and provided by the department,
1515 and include as part of or in connection with the application any
1616 information that the department reasonably requires, including
1717 information about the applicant's:
1818 (1) identity;
1919 (2) personal history;
2020 (3) experience; and
2121 (4) business record.
2222 (c) For the purpose of Subsection (a), the commissioner
2323 shall allow an individual to apply for a license electronically
2424 using the National Association of Insurance Commissioners Uniform
2525 Application for Individual Adjuster or Apprentice
2626 License/Registration as it existed on May 1, 2023.
2727 (d) The commissioner shall take any action necessary for
2828 this state to participate in and adopt the application procedures
2929 of the National Association of Insurance Commissioners National
3030 Insurance Producer Registry for the purpose of licensing and
3131 license renewal for independent adjusters.
3232 SECTION 2. Not later than September 1, 2024, the
3333 commissioner of insurance shall adopt rules to implement Section
3434 4101.052(d), Insurance Code, as added by this Act.
3535 SECTION 3. This Act takes effect September 1, 2023.
