| 5 | 5 | | relating to the requirement that certain persons taking oysters on |

| 6 | 6 | | a licensed commercial oyster boat obtain a commercial fisherman's |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 47.002(f), Parks and Wildlife Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (f) A person who takes or assists in taking oysters on a |
|---|
| 12 | 12 | | vessel licensed as a commercial oyster boat under Chapter 76 is |
|---|
| 13 | 13 | | [not] required to obtain or possess a general commercial |
|---|
| 14 | 14 | | fisherman's license. This subsection does not apply to the holder |
|---|
| 15 | 15 | | of a commercial oyster boat captain's license. |
|---|
| 16 | 16 | | SECTION 2. Section 76.101(d), Parks and Wildlife Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (d) Each member of the crew of a licensed commercial oyster |
|---|
| 19 | 19 | | boat is required to have a general commercial fisherman's license |
|---|
| 20 | 20 | | to take oysters while they are on a licensed boat that is being used |
|---|
| 21 | 21 | | to take oysters. This subsection does not apply to the holder of a |
|---|
| 22 | 22 | | commercial oyster boat captain's license. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
