| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 548.002, Transportation Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | Sec. 548.002. DEPARTMENT RULES. (a) The department may |
|---|
| 12 | 12 | | adopt rules to administer and enforce this chapter. |
|---|
| 13 | 13 | | (b) A rule adopted under this section may not prohibit the |
|---|
| 14 | 14 | | holder of a vehicle inspection station license from refusing to |
|---|
| 15 | 15 | | inspect a vehicle. |
|---|
| 16 | 16 | | SECTION 2. Section 548.501, Transportation Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | Sec. 548.501. INSPECTION FEES GENERALLY. (a) Except as |
|---|
| 19 | 19 | | provided by Section [Sections 548.503 and] 548.504, an inspection |
|---|
| 20 | 20 | | station may charge a fee for performing an [the fee for] inspection |
|---|
| 21 | 21 | | of a motor vehicle in an amount set by the operator of the |
|---|
| 22 | 22 | | inspection station [other than a moped is $12.50. The fee for |
|---|
| 23 | 23 | | inspection of a moped is $5.75]. |
|---|
| 24 | 24 | | (b) For each inspection performed at an inspection station |
|---|
| 25 | 25 | | under this section, [Out of each fee for an inspection,] $5.50 shall |
|---|
| 26 | 26 | | be remitted to the state under Section 548.509. |
|---|
| 27 | 27 | | SECTION 3. Section 548.503, Transportation Code, is amended |
|---|
| 28 | 28 | | to read as follows: |
|---|
| 29 | 29 | | Sec. 548.503. INITIAL TWO-YEAR INSPECTION OF PASSENGER CAR |
|---|
| 30 | 30 | | OR LIGHT TRUCK. (a) An inspection station may charge a fee for |
|---|
| 31 | 31 | | performing an [The fee for] inspection of a passenger car or light |
|---|
| 32 | 32 | | truck under Section 548.102 in an amount [shall be] set by the |
|---|
| 33 | 33 | | operator of the inspection station [department by rule on or before |
|---|
| 34 | 34 | | September 1 of each year. A fee set by the department under this |
|---|
| 35 | 35 | | subsection must be based on the costs of providing inspections and |
|---|
| 36 | 36 | | administering the program, but may not be less than $21.75]. |
