55 relating to contracts for the construction, repair, and renovation
66 of certain conservation and reclamation district facilities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 49.273(d) and (e), Water Code, are
99 amended to read as follows:
1010 (d) For contracts over $150,000 [$75,000], the board shall
1111 advertise the letting of the contract, including the general
1212 conditions, time, and place of opening of sealed bids. The notice
1313 must be published in one or more newspapers circulated in each
1414 county in which the district is located. If there are more than
1515 four counties in the district, notice may be published in any
1616 newspaper with general circulation in the district. The notice
1717 must be published once a week for two consecutive weeks before the
1818 date that the bids are opened, and the first publication must be not
1919 later than the 14th day before the date of the opening of the sealed
2020 bids.
2121 (e) For contracts over $25,000 but not more than $150,000
2222 [$75,000], the board shall solicit written competitive bids on
2323 uniform written specifications from at least three bidders.
2424 SECTION 2. Section 49.273, Water Code, as amended by this
2525 Act, applies only to a contract for which a governmental entity
2626 first advertises or otherwise requests bids, proposals, offers, or
2727 qualifications, or makes a similar solicitation, on or after the
2828 effective date of this Act.
2929 SECTION 3. This Act takes effect September 1, 2023.
