| 5 | 5 | | relating to contracts for the construction, repair, and renovation |

| 6 | 6 | | of certain conservation and reclamation district facilities. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Sections 49.273(d) and (e), Water Code, are |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (d) For contracts over $150,000 [$75,000], the board shall |
|---|
| 11 | 11 | | advertise the letting of the contract, including the general |
|---|
| 12 | 12 | | conditions, time, and place of opening of sealed bids. The notice |
|---|
| 13 | 13 | | must be published in one or more newspapers circulated in each |
|---|
| 14 | 14 | | county in which the district is located. If there are more than |
|---|
| 15 | 15 | | four counties in the district, notice may be published in any |
|---|
| 16 | 16 | | newspaper with general circulation in the district. The notice |
|---|
| 17 | 17 | | must be published once a week for two consecutive weeks before the |
|---|
| 18 | 18 | | date that the bids are opened, and the first publication must be not |
|---|
| 19 | 19 | | later than the 14th day before the date of the opening of the sealed |
|---|
| 20 | 20 | | bids. |
|---|
| 21 | 21 | | (e) For contracts over $25,000 but not more than $150,000 |
|---|
| 22 | 22 | | [$75,000], the board shall solicit written competitive bids on |
|---|
| 23 | 23 | | uniform written specifications from at least three bidders. |
|---|
| 24 | 24 | | SECTION 2. Section 49.273, Water Code, as amended by this |
|---|
| 25 | 25 | | Act, applies only to a contract for which a governmental entity |
|---|
| 26 | 26 | | first advertises or otherwise requests bids, proposals, offers, or |
|---|
| 27 | 27 | | qualifications, or makes a similar solicitation, on or after the |
|---|
| 28 | 28 | | effective date of this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
