44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to public school accountability.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 39.053, Education Code, is amended by
99 amending Subsection (c) and adding Subsection (c-4) to read as
1010 follows:
1111 (c) School districts and campuses must be evaluated based on
1212 four [three] domains of indicators of achievement adopted under
1313 this section that include:
1414 (1) in the student achievement domain, indicators of
1515 student achievement that must include:
1616 (A) for evaluating the performance of districts
1717 and campuses generally:
1818 (i) an indicator that accounts for the
1919 results of assessment instruments required under Sections
2020 39.023(a), (c), and (l), as applicable for the district and campus,
2121 including the results of assessment instruments required for
2222 graduation retaken by a student, aggregated across grade levels by
2323 subject area, including:
2424 (a) for the performance standard
2525 determined by the commissioner under Section 39.0241(a), the
2626 percentage of students who performed satisfactorily on the
2727 assessment instruments, aggregated across grade levels by subject
2828 area; and
2929 (b) for the college readiness
3030 performance standard as determined under Section 39.0241, the
3131 percentage of students who performed satisfactorily on the
3232 assessment instruments, aggregated across grade levels by subject
3333 area; and
3434 (ii) an indicator that accounts for the
3535 results of assessment instruments required under Section
3636 39.023(b), as applicable for the district and campus, including the
3737 percentage of students who performed satisfactorily on the
3838 assessment instruments, as determined by the performance standard
3939 adopted by the agency, aggregated across grade levels by subject
4040 area; and
4141 (B) for evaluating the performance of high school
4242 campuses and districts that include high school campuses,
4343 indicators that account for:
4444 (i) students who satisfy the Texas Success
4545 Initiative (TSI) college readiness benchmarks prescribed by the
4646 Texas Higher Education Coordinating Board under Section 51.334 on
4747 an assessment instrument in reading or mathematics designated by
4848 the coordinating board under that section;
4949 (ii) students who satisfy relevant
5050 performance standards on advanced placement tests or similar
5151 assessments;
5252 (iii) students who earn dual course credits
5353 in the dual credit courses;
5454 (iv) students who enlist in the armed
5555 forces of the United States;
5656 (v) students who earn industry
5757 certifications;
5858 (vi) students admitted into postsecondary
5959 industry certification programs that require as a prerequisite for
6060 entrance successful performance at the secondary level;
6161 (vii) students whose successful completion
6262 of a course or courses under Section 28.014 indicates the student's
6363 preparation to enroll and succeed, without remediation, in an
6464 entry-level general education course for a baccalaureate degree or
6565 associate degree;
6666 (viii) students who successfully met
6767 standards on a composite of indicators that through research
6868 indicates the student's preparation to enroll and succeed, without
6969 remediation, in an entry-level general education course for a
7070 baccalaureate degree or associate degree;
7171 (ix) high school graduation rates, computed
7272 in accordance with standards and definitions adopted in compliance
7373 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
7474 subject to the exclusions provided by Subsections (g), (g-1),
7575 (g-2), and (g-3);
7676 (x) students who successfully completed an
7777 OnRamps dual enrollment course;
7878 (xi) students who successfully completed a
7979 practicum or internship approved by the State Board of Education;
8080 and
8181 (xii) students who are awarded an associate
8282 degree;
8383 (2) in the school progress domain, indicators for
8484 effectiveness in promoting student learning, which must include:
8585 (A) for assessment instruments, including
8686 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
8787 percentage of students who met the standard for improvement, as
8888 determined by the commissioner; and
8989 (B) for evaluating relative performance,
9090 the performance of districts and campuses compared to similar
9191 districts or campuses; [and]
9292 (3) in the closing the gaps domain, the use of
9393 disaggregated data to demonstrate the differentials among students
9494 from different racial and ethnic groups, socioeconomic
9595 backgrounds, and other factors, including:
9696 (A) students formerly receiving special
9797 education services;
9898 (B) students continuously enrolled; and
9999 (C) students who are mobile; and
100100 (4) in the school portfolio domain for evaluating the
101101 performance of districts and campuses generally, indicators of
102102 school portfolio, which must include:
103103 (A) students who successfully complete courses
104104 in fine arts, physical education, or a language other than English,
105105 or other courses included in the enrichment curriculum under
106106 Section 28.002(a)(2);
107107 (B) students who participate in extracurricular
108108 activities, including University Interscholastic League activities
109109 such as academic, fine arts, and athletic events and foreign
110110 language, chess, and robotics clubs;
111111 (C) students who successfully complete the
112112 distinguished level of achievement under Section 28.025(b-7);
113113 (D) students who successfully complete at least
114114 one endorsement under Section 28.025(c-1);
115115 (E) students who successfully complete a
116116 coherent sequence of fine arts courses;
117117 (F) students who successfully complete a
118118 character education program provided under Section 29.906;
119119 (G) educationally disadvantaged students who
120120 successfully complete a postsecondary readiness course;
121121 (H) results from the school and student safety
122122 survey of districts and campuses administered under Section
123123 39.0531;
124124 (I) efforts by districts and campuses relating to
125125 increasing teacher retention, including providing mentoring
126126 programs and professional development opportunities;
127127 (J) health and wellness as determined by the
128128 commissioner in consultation with the State Board of Education and
129129 any appropriate advisory committees;
130130 (K) for campuses that serve students enrolled in
131131 prekindergarten, an indicator that accounts for student
132132 participation in full-day prekindergarten programs;
133133 (L) students in grades five, six, seven, and
134134 eight who earn credit for advanced courses;
135135 (M) students enrolled in grade nine for the first
136136 time who earn the credits required during that school year for
137137 promotion to the next grade level; and
138138 (N) students who are absent, as defined by
139139 Subsection (c-4), fewer than 15 days during the current school
140140 year.
141141 (c-4) In Subsection (c)(4)(N), "absent" means the student
142142 is not physically on school grounds and is not participating in
143143 instruction or instruction-related activities at an approved
144144 off-campus location for the school day, without regard to whether
145145 the absence is excused or unexcused.
146146 SECTION 2. Subchapter C, Chapter 39, Education Code, is
147147 amended by adding Section 39.0531 to read as follows:
148148 Sec. 39.0531. SCHOOL AND STUDENT SAFETY SURVEY. (a) The
149149 commissioner may incorporate a school and student safety survey as
150150 an indicator for the portfolio domain under Section 39.053(c)(4). A
151151 school and student safety survey shall be administered to
152152 administrators and teachers employed by school districts, students
153153 enrolled in school districts, and parents of those students.
154154 (b) The commissioner may adopt rules to implement this
155155 section, including rules to:
156156 (1) determine the format of the survey;
157157 (2) determine the questions that the survey must
158158 include;
159159 (3) establish a period during a school year in which
160160 the survey must be conducted;
161161 (4) establish requirements for administering and
162162 reporting the results of the survey; and
163163 (5) authorize the manner in which the survey may be
164164 administered, including the local administration of the survey.
165165 (c) Notwithstanding any other provision of this code,
166166 including Section 21.355, school and student safety survey
167167 information must be reported to the agency in accordance with rules
168168 adopted by the commissioner.
169169 (d) The commissioner may contract with a third party to
170170 provide any service necessary under this section.
171171 SECTION 3. Section 39.054(a-1), Education Code, is amended
172172 to read as follows:
173173 (a-1) For purposes of assigning an overall performance
174174 rating for a district or campus under Subsection (a), the
175175 commissioner shall:
176176 (1) consider either the district's or campus's
177177 performance rating under the student achievement domain under
178178 Section 39.053(c)(1) or the school progress domain under Section
179179 39.053(c)(2), whichever performance rating is higher, unless the
180180 district or campus received a performance rating of F in either
181181 domain, in which case the district or campus may not be assigned a
182182 performance rating higher than a B for the composite for the two
183183 domains; [and]
184184 (2) attribute not less than 30 percent of the
185185 performance rating to the closing the gaps domain under Section
186186 39.053(c)(3); and
187187 (3) attribute not less than 20 percent of the
188188 performance rating to the school portfolio domain under Section
189189 39.053(c)(4).
190190 SECTION 4. This Act takes effect immediately if it receives
191191 a vote of two-thirds of all the members elected to each house, as
192192 provided by Section 39, Article III, Texas Constitution. If this
193193 Act does not receive the vote necessary for immediate effect, this
194194 Act takes effect September 1, 2023.
