55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of public accountancy.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 901.252, Occupations Code, is amended to
1010 read as follows:
1111 Sec. 901.252. ELIGIBILITY REQUIREMENTS. To be eligible to
1212 receive a certificate, a person must:
1313 (1) satisfy the requirements of Section 901.253;
1414 (2) meet the education requirements established under
1515 Section 901.254 [or 901.255];
1616 (3) pass the uniform CPA examination;
1717 (4) meet the work experience requirements established
1818 under Section 901.256; and
1919 (5) pass an examination on the rules of professional
2020 conduct as determined by board rule.
2121 SECTION 2. Section 901.256(a), Occupations Code, is amended
2222 to read as follows:
2323 (a) To be eligible to receive a certificate, a person must
2424 complete[:
2525 [(1) at least two years of work experience under the
2626 supervision of a certified public accountant; or
2727 [(2)] at least one year of work experience acceptable to
2828 the board and under the supervision of a certified public
2929 accountant, including experience providing a service or advice
3030 involving accounting, attest services, management or financial
3131 advisory or consulting services, tax services, or other services
3232 the board considers appropriate for an accountant[, if the person:
3333 [(A) has completed at least 150 semester hours of
3434 college credits; or
3535 [(B) holds a graduate degree].
3636 SECTION 3. Section 901.304(a), Occupations Code, is amended
3737 to read as follows:
3838 (a) For each examination or reexamination, the board by rule
3939 shall apportion an amount of the total examination fee among the
4040 parts of the examination that an applicant is eligible to take on a
4141 particular examination date. For each examination or
4242 reexamination, the board shall collect from each applicant a fee
4343 set by board rule not to exceed the cost of administering the parts
4444 of the examination that the applicant is eligible to take.
4545 SECTION 4. The heading to Section 901.310, Occupations
4646 Code, is amended to read as follows:
4747 Sec. 901.310. PASSAGE OF [CONDITIONAL] EXAMINATION
4848 [CREDIT].
4949 SECTION 5. Section 901.310(c), Occupations Code, is amended
5050 to read as follows:
5151 (c) The board shall consider a person to have passed an
5252 examination if the person receives credit for each subject within
5353 the time prescribed by the board [by receiving conditional credit
5454 after September 1, 1989, and passing the remaining subjects within
5555 the six consecutive examinations following the examination for
5656 which the person receives conditional credit].
5757 SECTION 6. Section 901.311, Occupations Code, is amended to
5858 read as follows:
5959 Sec. 901.311. RESTRUCTURE OF EXAMINATION. On the
6060 restructuring of [If] the uniform CPA examination [is
6161 restructured], the board by rule shall determine the manner in
6262 which credit for a subject is integrated into the new structure.
6363 SECTION 7. Section 901.355(a), Occupations Code, is amended
6464 to read as follows:
6565 (a) The holder of a certificate, license, or degree
6666 authorizing the person to practice public accountancy in a foreign
6767 country who on or before September 1, 2023, registered [may
6868 register] with the board as the holder of a certificate, license, or
6969 degree issued by the foreign country may continue to practice in
7070 this state under that registration for as long as the person stays
7171 in compliance with the provisions of this chapter and board rules
7272 applicable to the person[, if the board determines that the
7373 standards under which the applicant was certified or otherwise
7474 authorized to practice public accountancy were at least as high as
7575 the standards of this state at the time that authority was granted].
7676 SECTION 8. The following provisions of the Occupations Code
7777 are repealed:
7878 (1) Section 901.255;
7979 (2) Sections 901.310(a) and (b); and
8080 (3) Sections 901.355(b) and (c).
8181 SECTION 9. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2023.
