66 AN ACT
77 relating to notification requirements for law enforcement agencies
88 regarding a missing child with an intellectual disability or mental
99 illness.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 63, Code of Criminal Procedure, is
1212 amended by adding Article 63.0093 to read as follows:
1313 Art. 63.0093. NOTIFICATION REGARDING MISSING CHILD WITH
1414 INTELLECTUAL DISABILITY OR MENTAL ILLNESS. (a) In this article,
1515 "intellectual disability" and "mental illness" have the meanings
1616 assigned by Article 46B.001.
1717 (b) As soon as practicable after a law enforcement agency
1818 detains, arrests, or releases a missing child with an intellectual
1919 disability or mental illness, the agency shall notify the missing
2020 child's parent, managing conservator, or guardian regarding the
2121 agency's detention, arrest, or release.
2222 SECTION 2. This Act takes effect September 1, 2023.
