10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 63, Code of Criminal Procedure, is |
---|
12 | 12 | | amended by adding Article 63.0093 to read as follows: |

13 | 13 | | Art. 63.0093. NOTIFICATION REGARDING MISSING CHILD WITH |

14 | 14 | | INTELLECTUAL DISABILITY OR MENTAL ILLNESS. (a) In this article, |
---|
15 | 15 | | "intellectual disability" and "mental illness" have the meanings |
---|
16 | 16 | | assigned by Article 46B.001. |

17 | 17 | | (b) As soon as practicable after a law enforcement agency |
---|
18 | 18 | | detains, arrests, or releases a missing child with an intellectual |
---|
19 | 19 | | disability or mental illness, the agency shall notify the missing |
---|
20 | 20 | | child's parent, managing conservator, or guardian regarding the |
---|
21 | 21 | | agency's detention, arrest, or release. |
---|
22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
