| 7 | 7 | | relating to the medical use of low-THC cannabis by patients with |

| 8 | 8 | | certain medical conditions. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 169.003, Occupations Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A |
|---|
| 13 | 13 | | physician described by Section 169.002 may prescribe low-THC |
|---|
| 14 | 14 | | cannabis to a patient if: |
|---|
| 15 | 15 | | (1) the patient is a permanent resident of the state; |
|---|
| 16 | 16 | | (2) the physician complies with the registration |
|---|
| 17 | 17 | | requirements of Section 169.004; and |
|---|
| 18 | 18 | | (3) the physician certifies to the department that: |
|---|
| 19 | 19 | | (A) the patient is diagnosed with: |
|---|
| 20 | 20 | | (i) epilepsy; |
|---|
| 21 | 21 | | (ii) a seizure disorder; |
|---|
| 22 | 22 | | (iii) multiple sclerosis; |
|---|
| 23 | 23 | | (iv) spasticity; |
|---|
| 24 | 24 | | (v) amyotrophic lateral sclerosis or |
|---|
| 25 | 25 | | another motor neuron disorder; |
|---|
| 26 | 26 | | (vi) autism; |
|---|
| 27 | 27 | | (vii) cancer; |
|---|
| 28 | 28 | | (viii) Parkinson's disease; |
|---|
| 29 | 29 | | (ix) cerebral palsy; |
|---|
| 30 | 30 | | (x) a brain tumor; |
|---|
| 31 | 31 | | (xi) vascular insult to the brain; |
|---|
| 32 | 32 | | (xii) a spinal cord disorder; |
|---|
| 33 | 33 | | (xiii) traumatic brain injury; |
|---|
| 34 | 34 | | (xiv) post-polio syndrome; |
|---|
| 35 | 35 | | (xv) muscular dystrophy; |
|---|
| 36 | 36 | | (xvi) myasthenia gravis; |
|---|
| 37 | 37 | | (xvii) peripheral neuropathy; |
|---|
| 38 | 38 | | (xviii) Huntington's disease, Friedreich's |
|---|
| 39 | 39 | | ataxia, spinocerebellar degeneration, or another [an] incurable |
|---|
| 40 | 40 | | neurodegenerative disease; |
|---|
| 41 | 41 | | (xix) [(ix)] post-traumatic stress |
|---|
| 42 | 42 | | disorder; or |
|---|
| 43 | 43 | | (xx) [(x)] a medical condition that is |
|---|
| 44 | 44 | | approved for a research program under Subchapter F, Chapter 487, |
|---|
| 45 | 45 | | Health and Safety Code, and for which the patient is receiving |
|---|
| 46 | 46 | | treatment under that program; and |
|---|
| 47 | 47 | | (B) the physician determines the risk of the |
|---|
| 48 | 48 | | medical use of low-THC cannabis by the patient is reasonable in |
|---|
| 49 | 49 | | light of the potential benefit for the patient. |
|---|
| 50 | 50 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2023. |
|---|
