55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the medical use of low-THC cannabis by patients with
88 certain medical conditions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 169.003, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A
1313 physician described by Section 169.002 may prescribe low-THC
1414 cannabis to a patient if:
1515 (1) the patient is a permanent resident of the state;
1616 (2) the physician complies with the registration
1717 requirements of Section 169.004; and
1818 (3) the physician certifies to the department that:
1919 (A) the patient is diagnosed with:
2020 (i) epilepsy;
2121 (ii) a seizure disorder;
2222 (iii) multiple sclerosis;
2323 (iv) spasticity;
2424 (v) amyotrophic lateral sclerosis or
2525 another motor neuron disorder;
2626 (vi) autism;
2727 (vii) cancer;
2828 (viii) Parkinson's disease;
2929 (ix) cerebral palsy;
3030 (x) a brain tumor;
3131 (xi) vascular insult to the brain;
3232 (xii) a spinal cord disorder;
3333 (xiii) traumatic brain injury;
3434 (xiv) post-polio syndrome;
3535 (xv) muscular dystrophy;
3636 (xvi) myasthenia gravis;
3737 (xvii) peripheral neuropathy;
3838 (xviii) Huntington's disease, Friedreich's
3939 ataxia, spinocerebellar degeneration, or another [an] incurable
4040 neurodegenerative disease;
4141 (xix) [(ix)] post-traumatic stress
4242 disorder; or
4343 (xx) [(x)] a medical condition that is
4444 approved for a research program under Subchapter F, Chapter 487,
4545 Health and Safety Code, and for which the patient is receiving
4646 treatment under that program; and
4747 (B) the physician determines the risk of the
4848 medical use of low-THC cannabis by the patient is reasonable in
4949 light of the potential benefit for the patient.
5050 SECTION 2. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2023.
