| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 172, Election Code, is |
|---|
| 11 | 11 | | amended by adding Section 172.0211 to read as follows: |
|---|
| 12 | 12 | | Sec. 172.0211. CANDIDACY PROHIBITED. (a) A candidate |
|---|
| 13 | 13 | | shall be prohibited from making an application for a place on the |
|---|
| 14 | 14 | | general primary election ballot with more than one political party |
|---|
| 15 | 15 | | in the same voting year. |
|---|
| 16 | 16 | | (b) If a candidate violates this section, any authority |
|---|
| 17 | 17 | | receiving an application from the candidate shall reject the |
|---|
| 18 | 18 | | application. |
|---|
| 19 | 19 | | (c) A candidate whose application is rejected under this |
|---|
| 20 | 20 | | section is not entitled to receive a refund of the filing fees for |
|---|
| 21 | 21 | | the rejected application. |
|---|
| 22 | 22 | | (d) A candidate whose application is rejected under this |
|---|
| 23 | 23 | | section is ineligible for a place on the ballot for the succeeding |
|---|
| 24 | 24 | | general election for state and county officers as: |
|---|
| 25 | 25 | | (1) an independent candidate for an office for which a |
|---|
| 26 | 26 | | candidate filed for a place on the ballot for the primary; |
|---|
| 27 | 27 | | (2) the nominee of a political party other than the |
|---|
| 28 | 28 | | party holding the primary in which the candidate filed an |
|---|
| 29 | 29 | | application for a place on the ballot; or |
|---|
| 30 | 30 | | (3) a write-in candidate for an office for which the |
|---|
| 31 | 31 | | candidate filed for a place on the ballot for the primary. |
|---|
| 32 | 32 | | (e) The secretary of state shall prescribe any procedures |
|---|
| 33 | 33 | | necessary to implement this section. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2023. |
