77 relating to a candidate's application for a place on the ballot for
88 a party's primary election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 172, Election Code, is
1111 amended by adding Section 172.0211 to read as follows:
1212 Sec. 172.0211. CANDIDACY PROHIBITED. (a) A candidate
1313 shall be prohibited from making an application for a place on the
1414 general primary election ballot with more than one political party
1515 in the same voting year.
1616 (b) If a candidate violates this section, any authority
1717 receiving an application from the candidate shall reject the
1818 application.
1919 (c) A candidate whose application is rejected under this
2020 section is not entitled to receive a refund of the filing fees for
2121 the rejected application.
2222 (d) A candidate whose application is rejected under this
2323 section is ineligible for a place on the ballot for the succeeding
2424 general election for state and county officers as:
2525 (1) an independent candidate for an office for which a
2626 candidate filed for a place on the ballot for the primary;
2727 (2) the nominee of a political party other than the
2828 party holding the primary in which the candidate filed an
2929 application for a place on the ballot; or
3030 (3) a write-in candidate for an office for which the
3131 candidate filed for a place on the ballot for the primary.
3232 (e) The secretary of state shall prescribe any procedures
3333 necessary to implement this section.
3434 SECTION 2. This Act takes effect September 1, 2023.
