66 AN ACT
77 relating to the establishment and operation of an ammunition
88 facility by the Department of Public Safety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 411, Government Code, is amended by
1111 adding Subchapter S to read as follows:
1212 SUBCHAPTER S. TEXAS AMMUNITION FACILITY
1313 Sec. 411.551. DEFINITIONS. In this subchapter:
1414 (1) "Ammunition" means a combination of projectiles,
1515 cartridges, primers, and propellants designed to be discharged from
1616 a firearm.
1717 (2) "Facility" means the Texas ammunition facility
1818 established under this subchapter.
1919 (3) "Facility operator" means the person selected
2020 under Section 411.552 to operate the facility.
2121 (4) "Law enforcement officer" means a person who is a
2222 peace officer under Article 2.12, Code of Criminal Procedure.
2323 (5) "Law enforcement officer trainee" means a person
2424 enrolled in the basic peace officer training course required for
2525 the issuance of a peace officer license under Chapter 1701,
2626 Occupations Code.
2727 (6) "Quality ammunition" means ammunition that meets
2828 the minimum safety specifications of the Sporting Arms and
2929 Ammunition Manufacturers' Institute for the caliber and type of
3030 cartridge manufactured, as specified.
3131 Sec. 411.552. TEXAS AMMUNITION FACILITY. (a) The
3232 department shall contract with a person to establish and operate a
3333 facility that acquires, stores, and resells to law enforcement
3434 agencies quality ammunition to ensure the availability of
3535 ammunition for use by those agencies for training and public safety
3636 with a preference for law enforcement officers and law enforcement
3737 officer trainees.
3838 (b) The department shall closely supervise the facility to
3939 promote and ensure integrity, security, honesty, and fairness in
4040 the operation of the facility.
4141 Sec. 411.553. CERTAIN CONTRACT PROVISIONS REQUIRED. A
4242 contract under this subchapter for the acquisition, storage, and
4343 resale of quality ammunition must include provisions requiring:
4444 (1) the person who establishes and operates the
4545 facility to give a preference when acquiring quality ammunition to
4646 manufacturers who manufacture ammunition in this state; and
4747 (2) the packaging for the ammunition to:
4848 (A) bear the state seal, state arms, or state
4949 flag; and
5050 (B) state "Made in Texas".
5151 Sec. 411.554. FACILITY OPERATOR POWERS AND DUTIES. (a) The
5252 facility operator has the powers necessary to carry out the duties
5353 imposed on the operator under a contract entered into under this
5454 subchapter.
5555 (b) The facility operator shall acquire and store quality
5656 ammunition to be resold at a reasonable price only to law
5757 enforcement agencies with a preference for use by law enforcement
5858 officers and law enforcement officer trainees.
5959 (c) The facility operator shall acquire and store
6060 sufficient quality ammunition to prepare for potential future
6161 shortages of ammunition from other sources.
6262 Sec. 411.555. CERTAIN SALES PROHIBITED. The facility may
6363 not sell ammunition or any component parts to any person except a
6464 law enforcement agency in this state that is accredited by one of
6565 the following organizations for adhering to best practices in
6666 policing:
6767 (1) the Texas Police Chiefs Association;
6868 (2) the Commission on Accreditation for Law
6969 Enforcement Agencies, Inc.; or
7070 (3) a successor organization to an organization
7171 described by Subdivision (1) or (2) that offers an accreditation
7272 program for best practices in policing.
7373 Sec. 411.556. DEDICATION OF REVENUE. Any proceeds
7474 collected by the department under a contract awarded under this
7575 subchapter shall be deposited in the general revenue fund to the
7676 credit of the law enforcement officer standards and education fund
7777 account and may be appropriated only for the purposes described by
7878 this subchapter or Section 1701.157, Occupations Code.
7979 Sec. 411.557. ANNUAL REPORT. Not later than December 1 of
8080 each year, the department shall submit a report to the governor and
8181 the legislature on the condition, operation, and projected business
8282 activity of the facility.
8383 SECTION 2. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2023.
