55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the bilingual education allotment under the public
88 school finance system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.054, Education Code, is amended by
1111 adding Subsection (e) to read as follows:
1212 (e) Notwithstanding Section 29.066(c), the agency may
1313 require, for purposes of implementing Section 48.105, a school
1414 district that is granted an exception under this section to:
1515 (1) include in the district's Public Education
1616 Information Management System (PEIMS) report additional
1717 information specified by the agency and relating to the alternative
1818 language education methods used by the district; and
1919 (2) classify the alternative language education
2020 method used by the district under the Public Education Information
2121 Management System (PEIMS) report as specified by the agency.
2222 SECTION 2. Section 48.105(a), Education Code, is amended to
2323 read as follows:
2424 (a) For each student in average daily attendance in a
2525 bilingual education or special language program under Subchapter B,
2626 Chapter 29, or an alternative language method offered by a school
2727 district and approved by the agency under Section 29.054(d), a
2828 district is entitled to an annual allotment equal to the basic
2929 allotment multiplied by:
3030 (1) for an emergent bilingual student, as defined by
3131 Section 29.052:
3232 (A) 0.1; or
3333 (B) 0.15 if the student is in a bilingual
3434 education program or an alternative language method offered by a
3535 school district and approved by the agency under Section 29.054(d)
3636 using a dual language immersion/one-way or two-way program model;
3737 and
3838 (2) for a student not described by Subdivision (1),
3939 0.05 if the student is in a bilingual education program or an
4040 alternative language method offered by a school district and
4141 approved by the agency under Section 29.054(d) using a dual
4242 language immersion/two-way program model.
4343 SECTION 3. This Act takes effect September 1, 2023.
