55 relating to increasing the criminal penalty for certain offenses if
66 committed at certain locations.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter D, Chapter 12, Penal Code, is amended
99 by adding Section 12.502 to read as follows:
1010 Sec. 12.502. PENALTY IF OFFENSE COMMITTED ON PREMISES OF
1111 POSTSECONDARY EDUCATIONAL INSTITUTION. (a) In this section:
1212 (1) "Postsecondary educational institution" means:
1313 (A) an institution of higher education or a
1414 private or independent institution of higher education as defined
1515 by Section 61.003, Education Code; or
1616 (B) a career school or college as defined by
1717 Section 132.001, Education Code.
1818 (2) "Premises" means real property and all buildings
1919 and appurtenances pertaining to the real property.
2020 (b) Except as provided by Subsection (c), if it is shown on
2121 the trial of an offense under Section 21.07, 21.08, 21.15, or 21.17
2222 that the offense was committed in a location that was on the
2323 premises of a postsecondary educational institution, the category
2424 of punishment for the offense is increased to a higher category of
2525 offense as follows:
2626 (1) a Class C misdemeanor is increased to a Class B
2727 misdemeanor;
2828 (2) a Class B misdemeanor is increased to a Class A
2929 misdemeanor;
3030 (3) a Class A misdemeanor is increased to a state jail
3131 felony; and
3232 (4) a state jail felony is increased to a felony of the
3333 third degree.
3434 (c) For an offense otherwise punishable under Subsection
3535 (b), if it is shown on the trial of the offense that the person has
3636 been previously convicted twice of an offense under Section 21.07,
3737 21.08, 21.15, or 21.17 for which the punishment was increased under
3838 Subsection (b), the category of punishment for the offense is
3939 increased to a higher category of offense as follows:
4040 (1) a Class C misdemeanor is increased to a Class A
4141 misdemeanor;
4242 (2) a Class B misdemeanor is increased to a state jail
4343 felony;
4444 (3) a Class A misdemeanor is increased to a felony of
4545 the third degree; and
4646 (4) a state jail felony is increased to a felony of the
4747 second degree.
4848 (d) If the punishment scheme for an offense under Section
4949 21.07, 21.08, 21.15, or 21.17 contains a specific enhancement
5050 provision increasing punishment to a higher minimum term of
5151 punishment than the minimum term required by the applicable higher
5252 category of offense prescribed by Subsection (b) or (c), the
5353 specific enhancement provision controls over this section.
5454 (e) A previous conviction may be used for purposes of
5555 enhancement under this section or under another provision of
5656 Subchapter D, Chapter 12, but not under both this section and the
5757 other provision.
5858 SECTION 2. Section 20A.02(b-1), Penal Code, is amended to
5959 read as follows:
6060 (b-1) An offense under this section is a felony of the first
6161 degree punishable by imprisonment in the Texas Department of
6262 Criminal Justice for life or for a term of not more than 99 years or
6363 less than 25 years if it is shown on the trial of the offense that
6464 the actor committed the offense in a location that was:
6565 (1) on the premises of or within 1,000 feet of the
6666 premises of:
6767 (A) a school; or
6868 (B) an institution of higher education or private
6969 or independent institution of higher education, as defined by
7070 Section 61.003, Education Code; or
7171 (2) on premises or within 1,000 feet of premises
7272 where:
7373 (A) an official school function was taking place;
7474 or
7575 (B) an event sponsored or sanctioned by the
7676 University Interscholastic League was taking place.
7777 SECTION 3. The change in law made by this Act applies only
7878 to an offense committed on or after the effective date of this Act.
7979 An offense committed before the effective date of this Act is
8080 governed by the law in effect on the date the offense was committed,
8181 and the former law is continued in effect for that purpose. For
8282 purposes of this section, an offense was committed before the
8383 effective date of this Act if any element of the offense occurred
8484 before that date.
8585 SECTION 4. This Act takes effect September 1, 2023.
