| 8 | 8 | | candidates for certain offices. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 254, Election Code, is |
|---|
| 11 | 11 | | amended by adding Section 254.0645 to read as follows: |
|---|
| 12 | 12 | | Sec. 254.0645. SPECIAL REPORT BY CERTAIN CANDIDATES. (a) |
|---|
| 13 | 13 | | In addition to other reports required by this chapter, the |
|---|
| 14 | 14 | | following candidates shall file additional reports with the |
|---|
| 15 | 15 | | commission during the period beginning January 1 and ending the |
|---|
| 16 | 16 | | ninth day before election day: |
|---|
| 17 | 17 | | (1) a candidate for state senator, state |
|---|
| 18 | 18 | | representative, or the State Board of Education who accepts during |
|---|
| 19 | 19 | | that reporting period political contributions from one person that |
|---|
| 20 | 20 | | in the aggregate exceed $10,000; and |
|---|
| 21 | 21 | | (2) a candidate for a statewide office who accepts |
|---|
| 22 | 22 | | during that reporting period political contributions from one |
|---|
| 23 | 23 | | person that in the aggregate exceed $25,000. |
|---|
| 24 | 24 | | (b) Each report under this section must include: |
|---|
| 25 | 25 | | (1) the amount of each political contribution; |
|---|
| 26 | 26 | | (2) the full name and address of the person making the |
|---|
| 27 | 27 | | political contribution; and |
|---|
| 28 | 28 | | (3) the date each political contribution was made. |
|---|
| 29 | 29 | | (c) A candidate who is required to file a report under this |
|---|
| 30 | 30 | | section shall file the report electronically, by telephonic |
|---|
| 31 | 31 | | facsimile machine, or by hand, in the form required by Section |
|---|
| 32 | 32 | | 254.036 not later than: |
|---|
| 33 | 33 | | (1) 5 p.m. of the first business day after the date the |
|---|
| 34 | 34 | | contribution is accepted, if the report is filed by telephonic |
|---|
| 35 | 35 | | facsimile machine or hand; or |
|---|
| 36 | 36 | | (2) midnight of the first business day after the date |
|---|
| 37 | 37 | | the contribution is accepted, if the report is filed |
|---|
| 38 | 38 | | electronically. |
|---|
| 39 | 39 | | (d) A report under this section is not required to be |
|---|
| 40 | 40 | | accompanied by the affidavit required under Section 254.036(h) or |
|---|
| 41 | 41 | | to be submitted on a form prescribed by the commission. A report |
|---|
| 42 | 42 | | under this section that complies with Section 254.036(a) must be |
|---|
| 43 | 43 | | accompanied by an affidavit under Section 254.036(c)(1), unless the |
|---|
| 44 | 44 | | candidate has submitted an affidavit under Section 254.036(c)(1) |
|---|
| 45 | 45 | | with another report filed in connection with the election for which |
|---|
| 46 | 46 | | a report is required under this section. |
|---|
| 47 | 47 | | (e) To the extent of a conflict between this section and |
|---|
| 48 | 48 | | Section 254.036, this section prevails. |
|---|
| 49 | 49 | | SECTION 2. This Act takes effect September 1, 2023. |
