55 AN ACT
66 relating to the regulation by the Texas Department of Licensing and
77 Regulation of an eyelash extension application training program and
88 to the practice of cosmetology by an eyelash specialist license
99 holder.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter E-3, Chapter 1603, Occupations Code,
1212 is amended by adding Section 1603.23071 to read as follows:
1313 Sec. 1603.23071. METHODS OF INSTRUCTION IN EYELASH
1414 EXTENSION APPLICATION. (a) This section applies to the curriculum
1515 content for an eyelash extension application training program for a
1616 license under Section 1603.2103(a)(8) and approved by the
1717 department under Section 1603.2307.
1818 (b) A school offering an eyelash extension application
1919 training program shall determine:
2020 (1) the number of hours to be designated as the theory
2121 portion, which may be provided through distance education; and
2222 (2) the number of hours to be designated as the
2323 practical portion, which must be provided through in-person
2424 instruction.
2525 SECTION 2. Section 1603.0011(c), Occupations Code, is
2626 amended to read as follows:
2727 (c) In addition to the services described by Subsection (a),
2828 the practice of cosmetology includes:
2929 (1) performing or offering to perform for compensation
3030 the service of applying semipermanent, thread-like extensions
3131 composed of single fibers to a person's eyelashes; and
3232 (2) altering the shape or color of a person's eyelashes
3333 using a cosmetic preparation or appliance.
3434 SECTION 3. Section 1603.2103(a), Occupations Code, is
3535 amended to read as follows:
3636 (a) A person holding:
3737 (1) a Class A barber license may perform any barbering
3838 service;
3939 (2) a cosmetology operator license may perform any
4040 cosmetology service;
4141 (3) a manicurist license may perform any service
4242 described by Section 1603.0011(a)(7) or (8);
4343 (4) an esthetician license may perform any service
4444 described by Section 1603.0011(a)(3), (4), (5), or (6) or (c);
4545 (5) a manicurist/esthetician license may perform any
4646 service described by Section 1603.0011(a)(3), (4), (5), (6), (7),
4747 or (8) or (c);
4848 (6) a hair weaving specialist license may perform any
4949 service described by Section 1603.0011(a)(9);
5050 (7) a hair weaving specialist/esthetician license may
5151 perform any service described by Section 1603.0011(a)(3), (4), (5),
5252 (6), or (9) or (c); and
5353 (8) an eyelash [extension] specialist license may
5454 perform any service described by Section 1603.0011(c).
5555 SECTION 4. Section 1603.2203(a), Occupations Code, is
5656 amended to read as follows:
5757 (a) An establishment licensed as:
5858 (1) an establishment may provide any barbering or
5959 cosmetology service;
6060 (2) a manicurist specialty establishment may provide
6161 any service described by Section 1603.0011(a)(7) or (8);
6262 (3) an esthetician specialty establishment may
6363 provide any service described by Section 1603.0011(a)(3), (4), (5),
6464 or (6) or (c);
6565 (4) a manicurist/esthetician specialty establishment
6666 may provide any service described by Section 1603.0011(a)(3), (4),
6767 (5), (6), (7), or (8) or (c);
6868 (5) a hair weaving specialty establishment may provide
6969 any service described by Section 1603.0011(a)(9);
7070 (6) an eyelash [extension] specialty establishment
7171 may provide any service described by Section 1603.0011(c);
7272 (7) a mini-establishment may provide any barbering or
7373 cosmetology service; and
7474 (8) a mobile establishment may provide any barbering
7575 or cosmetology service.
7676 SECTION 5. Not later than December 31, 2023, the Texas
7777 Commission of Licensing and Regulation shall adopt rules to
7878 implement Section 1603.23071, Occupations Code, as added by this
7979 Act.
8080 SECTION 6. The changes in law made by this Act apply only to
8181 the curriculum content requirements for a student who registers for
8282 an eyelash extension application training program on or after
8383 January 1, 2024.
8484 SECTION 7. This Act takes effect September 1, 2023.
