| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter E-3, Chapter 1603, Occupations Code, |
|---|
| 12 | 12 | | is amended by adding Section 1603.23071 to read as follows: |
|---|
| 13 | 13 | | Sec. 1603.23071. METHODS OF INSTRUCTION IN EYELASH |
|---|
| 14 | 14 | | EXTENSION APPLICATION. (a) This section applies to the curriculum |
|---|
| 15 | 15 | | content for an eyelash extension application training program for a |
|---|
| 16 | 16 | | license under Section 1603.2103(a)(8) and approved by the |
|---|
| 17 | 17 | | department under Section 1603.2307. |
|---|
| 18 | 18 | | (b) A school offering an eyelash extension application |
|---|
| 19 | 19 | | training program shall determine: |
|---|
| 20 | 20 | | (1) the number of hours to be designated as the theory |
|---|
| 21 | 21 | | portion, which may be provided through distance education; and |
|---|
| 22 | 22 | | (2) the number of hours to be designated as the |
|---|
| 23 | 23 | | practical portion, which must be provided through in-person |
|---|
| 24 | 24 | | instruction. |
|---|
| 25 | 25 | | SECTION 2. Section 1603.0011(c), Occupations Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | (c) In addition to the services described by Subsection (a), |
|---|
| 28 | 28 | | the practice of cosmetology includes: |
|---|
| 29 | 29 | | (1) performing or offering to perform for compensation |
|---|
| 30 | 30 | | the service of applying semipermanent, thread-like extensions |
|---|
| 31 | 31 | | composed of single fibers to a person's eyelashes; and |
|---|
| 32 | 32 | | (2) altering the shape or color of a person's eyelashes |
|---|
| 33 | 33 | | using a cosmetic preparation or appliance. |
|---|
| 34 | 34 | | SECTION 3. Section 1603.2103(a), Occupations Code, is |
|---|
| 35 | 35 | | amended to read as follows: |
|---|
| 36 | 36 | | (a) A person holding: |
|---|
| 37 | 37 | | (1) a Class A barber license may perform any barbering |
|---|
| 38 | 38 | | service; |
|---|
| 39 | 39 | | (2) a cosmetology operator license may perform any |
|---|
| 40 | 40 | | cosmetology service; |
|---|
| 41 | 41 | | (3) a manicurist license may perform any service |
|---|
| 42 | 42 | | described by Section 1603.0011(a)(7) or (8); |
|---|
| 43 | 43 | | (4) an esthetician license may perform any service |
|---|
| 44 | 44 | | described by Section 1603.0011(a)(3), (4), (5), or (6) or (c); |
|---|
| 45 | 45 | | (5) a manicurist/esthetician license may perform any |
|---|
| 46 | 46 | | service described by Section 1603.0011(a)(3), (4), (5), (6), (7), |
|---|
| 47 | 47 | | or (8) or (c); |
|---|
| 48 | 48 | | (6) a hair weaving specialist license may perform any |
|---|
| 49 | 49 | | service described by Section 1603.0011(a)(9); |
|---|
| 50 | 50 | | (7) a hair weaving specialist/esthetician license may |
|---|
| 51 | 51 | | perform any service described by Section 1603.0011(a)(3), (4), (5), |
|---|
| 52 | 52 | | (6), or (9) or (c); and |
|---|
| 53 | 53 | | (8) an eyelash [extension] specialist license may |
|---|
| 54 | 54 | | perform any service described by Section 1603.0011(c). |
|---|
| 55 | 55 | | SECTION 4. Section 1603.2203(a), Occupations Code, is |
|---|
| 56 | 56 | | amended to read as follows: |
|---|
| 57 | 57 | | (a) An establishment licensed as: |
|---|
| 58 | 58 | | (1) an establishment may provide any barbering or |
|---|
| 59 | 59 | | cosmetology service; |
|---|
| 60 | 60 | | (2) a manicurist specialty establishment may provide |
|---|
| 61 | 61 | | any service described by Section 1603.0011(a)(7) or (8); |
|---|
| 62 | 62 | | (3) an esthetician specialty establishment may |
|---|
| 63 | 63 | | provide any service described by Section 1603.0011(a)(3), (4), (5), |
|---|
| 64 | 64 | | or (6) or (c); |
|---|
| 65 | 65 | | (4) a manicurist/esthetician specialty establishment |
|---|
| 66 | 66 | | may provide any service described by Section 1603.0011(a)(3), (4), |
|---|
| 67 | 67 | | (5), (6), (7), or (8) or (c); |
|---|
| 68 | 68 | | (5) a hair weaving specialty establishment may provide |
|---|
| 69 | 69 | | any service described by Section 1603.0011(a)(9); |
|---|
| 70 | 70 | | (6) an eyelash [extension] specialty establishment |
|---|
| 71 | 71 | | may provide any service described by Section 1603.0011(c); |
|---|
| 72 | 72 | | (7) a mini-establishment may provide any barbering or |
|---|
| 73 | 73 | | cosmetology service; and |
|---|
| 74 | 74 | | (8) a mobile establishment may provide any barbering |
|---|
| 75 | 75 | | or cosmetology service. |
|---|
| 76 | 76 | | SECTION 5. Not later than December 31, 2023, the Texas |
|---|
| 77 | 77 | | Commission of Licensing and Regulation shall adopt rules to |
|---|
| 78 | 78 | | implement Section 1603.23071, Occupations Code, as added by this |
|---|
| 79 | 79 | | Act. |
|---|
| 80 | 80 | | SECTION 6. The changes in law made by this Act apply only to |
|---|
| 81 | 81 | | the curriculum content requirements for a student who registers for |
|---|
| 82 | 82 | | an eyelash extension application training program on or after |
|---|
| 83 | 83 | | January 1, 2024. |
|---|
| 84 | 84 | | SECTION 7. This Act takes effect September 1, 2023. |
