55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exclusion of certain resources in determining
88 eligibility for financial assistance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.032(d), Human Resources Code, is
1111 amended to read as follows:
1212 (d) In determining whether an applicant is eligible for
1313 assistance, the commission shall exclude from the applicant's
1414 available resources:
1515 (1) $5,000 [$1,000] for the applicant's household,
1616 including a household in which there is a person with a disability
1717 or a person who is at least 60 years of age; and
1818 (2) the fair market value of the applicant's ownership
1919 interest in one or more [a] motor vehicles:
2020 (A) not to exceed $15,000 for the first motor
2121 vehicle; and
2222 (B) not to exceed $4,650 for each additional
2323 motor vehicle [, but not more than $5,000 plus or minus an amount to
2424 be determined annually beginning on October 1, 1997, to reflect
2525 changes in the new car component of the Consumer Price Index for All
2626 Urban Consumers published by the Bureau of Labor Statistics].
2727 SECTION 2. The changes in law made by this Act apply to an
2828 initial determination or redetermination of eligibility of a person
2929 for financial assistance under Chapter 31, Human Resources Code,
3030 that is made on or after the effective date of this Act.
3131 SECTION 3. If before implementing any provision of this Act
3232 a state agency determines that a waiver or authorization from a
3333 federal agency is necessary for implementation of that provision,
3434 the agency affected by the provision shall request the waiver or
3535 authorization and may delay implementing that provision until the
3636 waiver or authorization is granted.
3737 SECTION 4. This Act takes effect September 1, 2023.
