| 7 | 7 | | relating to the exclusion of certain resources in determining |

| 8 | 8 | | eligibility for financial assistance. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.032(d), Human Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (d) In determining whether an applicant is eligible for |
|---|
| 13 | 13 | | assistance, the commission shall exclude from the applicant's |
|---|
| 14 | 14 | | available resources: |
|---|
| 15 | 15 | | (1) $5,000 [$1,000] for the applicant's household, |
|---|
| 16 | 16 | | including a household in which there is a person with a disability |
|---|
| 17 | 17 | | or a person who is at least 60 years of age; and |
|---|
| 18 | 18 | | (2) the fair market value of the applicant's ownership |
|---|
| 19 | 19 | | interest in one or more [a] motor vehicles: |
|---|
| 20 | 20 | | (A) not to exceed $15,000 for the first motor |
|---|
| 21 | 21 | | vehicle; and |
|---|
| 22 | 22 | | (B) not to exceed $4,650 for each additional |
|---|
| 23 | 23 | | motor vehicle [, but not more than $5,000 plus or minus an amount to |
|---|
| 24 | 24 | | be determined annually beginning on October 1, 1997, to reflect |
|---|
| 25 | 25 | | changes in the new car component of the Consumer Price Index for All |
|---|
| 26 | 26 | | Urban Consumers published by the Bureau of Labor Statistics]. |
|---|
| 27 | 27 | | SECTION 2. The changes in law made by this Act apply to an |
|---|
| 28 | 28 | | initial determination or redetermination of eligibility of a person |
|---|
| 29 | 29 | | for financial assistance under Chapter 31, Human Resources Code, |
|---|
| 30 | 30 | | that is made on or after the effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 32 | 32 | | a state agency determines that a waiver or authorization from a |
|---|
| 33 | 33 | | federal agency is necessary for implementation of that provision, |
|---|
| 34 | 34 | | the agency affected by the provision shall request the waiver or |
|---|
| 35 | 35 | | authorization and may delay implementing that provision until the |
|---|
| 36 | 36 | | waiver or authorization is granted. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2023. |
