55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to money awarded to providers of women's health services
88 and family planning services, including the repeal of prohibitions
99 on the provision of those services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 531.0025, Government Code, is amended to
1212 read as follows:
1313 Sec. 531.0025. [RESTRICTIONS ON] AWARDS TO FAMILY PLANNING
1414 SERVICE PROVIDERS. (a) Notwithstanding any other law, money
1515 appropriated to the commission [Department of State Health
1616 Services] for the purpose of providing family planning services
1717 must be awarded[:
1818 [(1)] to eligible public and nonpublic entities that
1919 provide family planning services in the following order of
2020 descending priority:
2121 (1) entities with a demonstrated, evidence-based,
2222 historical capability of achieving the patient and service
2323 utilization goals the commission establishes for family planning
2424 services; and
2525 (2) entities with an increased probability of
2626 achieving the goals described by Subdivision (1)
2727 [(A) public entities that provide family
2828 planning services, including state, county, and local community
2929 health clinics and federally qualified health centers;
3030 [(B) nonpublic entities that provide
3131 comprehensive primary and preventive care services in addition to
3232 family planning services; and
3333 [(C) nonpublic entities that provide family
3434 planning services but do not provide comprehensive primary and
3535 preventive care services; or
3636 [(2) as otherwise directed by the legislature in the
3737 General Appropriations Act].
3838 (b) Notwithstanding Subsection (a), the commission
3939 [Department of State Health Services] shall, in compliance with
4040 federal law, ensure distribution of funds for family planning
4141 services in a manner that provides equitable [does not severely
4242 limit or eliminate] access to [those] services in all regions [any
4343 region] of the state.
4444 SECTION 2. The following provisions are repealed:
4545 (1) Chapter 2273, Government Code; and
4646 (2) Section 32.024(c-1), Human Resources Code.
4747 SECTION 3. This Act takes effect September 1, 2023.
