| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter A, Chapter 21, Local Government Code, |
|---|
| 9 | 9 | | is amended by adding Section 21.006 to read as follows: |
|---|
| 10 | 10 | | Sec. 21.006. ELECTION OF ENTIRE GOVERNING BODY UPON |
|---|
| 11 | 11 | | APPORTIONMENT. (a) A municipality that is divided into districts, |
|---|
| 12 | 12 | | wards, or other areas from which members of its governing body are |
|---|
| 13 | 13 | | elected shall elect all members of the municipality's governing |
|---|
| 14 | 14 | | body following each apportionment on the first uniform election |
|---|
| 15 | 15 | | date that allows sufficient time to comply with any requirements of |
|---|
| 16 | 16 | | law. |
|---|
| 17 | 17 | | (b) If members of the governing body of a municipality |
|---|
| 18 | 18 | | described by Subsection (a) serve staggered terms, the municipality |
|---|
| 19 | 19 | | shall adopt an equitable process to determine which members of the |
|---|
| 20 | 20 | | governing body serve shorter terms to accommodate an election |
|---|
| 21 | 21 | | following apportionment that accounts for the remaining time in |
|---|
| 22 | 22 | | each member's term and whether the term of any member elected from a |
|---|
| 23 | 23 | | particular district, ward, or area was previously shortened under |
|---|
| 24 | 24 | | this section. |

| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
