77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 21, Local Government Code,
99 is amended by adding Section 21.006 to read as follows:
1010 Sec. 21.006. ELECTION OF ENTIRE GOVERNING BODY UPON
1111 APPORTIONMENT. (a) A municipality that is divided into districts,
1212 wards, or other areas from which members of its governing body are
1313 elected shall elect all members of the municipality's governing
1414 body following each apportionment on the first uniform election
1515 date that allows sufficient time to comply with any requirements of
1616 law.
1717 (b) If members of the governing body of a municipality
1818 described by Subsection (a) serve staggered terms, the municipality
1919 shall adopt an equitable process to determine which members of the
2020 governing body serve shorter terms to accommodate an election
2121 following apportionment that accounts for the remaining time in
2222 each member's term and whether the term of any member elected from a
2323 particular district, ward, or area was previously shortened under
2424 this section.
2525 SECTION 2. This Act takes effect September 1, 2023.
