99 AN ACT
1010 relating to allowing public schools to employ or accept as
1111 volunteers chaplains.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle D, Title 2, Education Code, is amended
1414 by adding Chapter 23 to read as follows:
1515 CHAPTER 23. SCHOOL CHAPLAINS
1616 Sec. 23.001. SCHOOL CHAPLAINS. A school district or an
1717 open-enrollment charter school may employ or accept as a volunteer
1818 a chaplain to provide support, services, and programs for students
1919 as assigned by the board of trustees of the district or the
2020 governing body of the school. A chaplain employed or volunteering
2121 under this chapter is not required to be certified by the State
2222 Board for Educator Certification.
2323 SECTION 2. Section 48.115(b), Education Code, is amended to
2424 read as follows:
2525 (b) Funds allocated under this section must be used to
2626 improve school safety and security, including costs associated
2727 with:
2828 (1) securing school facilities, including:
2929 (A) improvements to school infrastructure;
3030 (B) the use or installation of physical barriers;
3131 and
3232 (C) the purchase and maintenance of:
3333 (i) security cameras or other security
3434 equipment; and
3535 (ii) technology, including communications
3636 systems or devices, that facilitates communication and information
3737 sharing between students, school personnel, and first responders in
3838 an emergency;
3939 (2) providing security for the district, including:
4040 (A) employing school district peace officers,
4141 private security officers, and school marshals; and
4242 (B) collaborating with local law enforcement
4343 agencies, such as entering into a memorandum of understanding for
4444 the assignment of school resource officers to schools in the
4545 district;
4646 (3) school safety and security training and planning,
4747 including:
4848 (A) active shooter and emergency response
4949 training;
5050 (B) prevention and treatment programs relating
5151 to addressing adverse childhood experiences; and
5252 (C) the prevention, identification, and
5353 management of emergencies and threats, using evidence-based,
5454 effective prevention practices and including:
5555 (i) providing licensed counselors, social
5656 workers, chaplains, and individuals trained in restorative
5757 discipline and restorative justice practices;
5858 (ii) providing mental health personnel and
5959 support, including chaplains;
6060 (iii) providing behavioral health
6161 services, including services provided by chaplains;
6262 (iv) establishing threat reporting
6363 systems; and
6464 (v) developing and implementing programs
6565 focused on restorative justice practices, culturally relevant
6666 instruction, and providing mental health support, including
6767 support provided by chaplains; and
6868 (4) providing programs related to suicide prevention,
6969 intervention, and postvention, including programs provided by
7070 chaplains.
7171 SECTION 3. Each board of trustees of a school district and
7272 each governing body of an open-enrollment charter school shall take
7373 a record vote not later than six months after the effective date of
7474 this Act on whether to adopt a policy authorizing a campus of the
7575 district or school to employ or accept as a volunteer a chaplain
7676 under Chapter 23, Education Code, as added by this Act.
7777 SECTION 4. This Act applies beginning with the 2023-2024
7878 school year.
7979 SECTION 5. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2023.
