|---|
| 8 | 8 | | event at which both schools participate. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 37, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 37.08131 to read as follows: |
|---|
| 12 | 12 | | Sec. 37.08131. MEMORANDUM OF UNDERSTANDING BETWEEN PUBLIC |
|---|
| 13 | 13 | | AND PRIVATE SCHOOLS REGARDING SCHOOL MARSHALS. (a) In this |
|---|
| 14 | 14 | | section, "public or private primary or secondary school" means a |
|---|
| 15 | 15 | | school district, open-enrollment charter school, or private |
|---|
| 16 | 16 | | school. |
|---|
| 17 | 17 | | (b) A public or private primary or secondary school may |
|---|
| 18 | 18 | | enter into a memorandum of understanding with another public or |
|---|
| 19 | 19 | | private primary or secondary school under which a school marshal |
|---|
| 20 | 20 | | appointed to a campus of the school may temporarily act as a school |
|---|
| 21 | 21 | | marshal at a campus of the other school for the duration of an event |
|---|
| 22 | 22 | | occurring at the campus of the other school at which both schools |
|---|
| 23 | 23 | | are participating. The memorandum of understanding must comply |
|---|
| 24 | 24 | | with the requirements for written regulations under Section 37.0811 |
|---|
| 25 | 25 | | or 37.0813, as applicable, and may be used to satisfy the |
|---|
| 26 | 26 | | requirement for written regulations or written authorization under |
|---|
| 27 | 27 | | Section 46.03(a)(1), Penal Code, to allow that school marshal to |
|---|
| 28 | 28 | | carry a firearm on the premises of the public or private primary or |
|---|
| 29 | 29 | | secondary school at which the event occurs. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2023. |
