| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 2165, Government Code, is |

| 10 | 10 | | amended by adding Section 2165.010 to read as follows: |

| 11 | 11 | | Sec. 2165.010. PROHIBITION ON SMOKING TOBACCO INSIDE OR ON |
|---|
| 12 | 12 | | GROUNDS OF CERTAIN STATE BUILDINGS; CRIMINAL OFFENSE. (a) In this |
|---|
| 13 | 13 | | section, "state agency" means a department, commission, board, |
|---|
| 14 | 14 | | office, or other agency in the executive, legislative, or judicial |
|---|
| 15 | 15 | | branch of state government created by the state constitution or a |
|---|
| 16 | 16 | | statute. The term does not include a university system or an |
|---|
| 17 | 17 | | institution of higher education as defined by Section 61.003, |
|---|
| 18 | 18 | | Education Code. |
|---|
| 19 | 19 | | (b) A person commits an offense if the person smokes tobacco |
|---|
| 20 | 20 | | inside or on the grounds of a building owned by the state in which a |
|---|
| 21 | 21 | | state agency's office is located. |
|---|
| 22 | 22 | | (c) An offense under Subsection (b) is a Class C misdemeanor |
|---|
| 23 | 23 | | punishable by a fine not to exceed $50. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
