99 AN ACT
1010 relating to the permissible uses of the school safety allotment
1111 under the Foundation School Program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 48.115(b), Education Code, is amended to
1414 read as follows:
1515 (b) Funds allocated under this section must be used to
1616 improve school safety and security, including costs associated
1717 with:
1818 (1) securing school facilities, including:
1919 (A) improvements to school infrastructure;
2020 (B) the use or installation of physical barriers;
2121 and
2222 (C) the purchase and maintenance of:
2323 (i) security cameras or other security
2424 equipment; and
2525 (ii) technology, including communications
2626 systems or devices, that facilitates communication and information
2727 sharing between students, school personnel, and first responders in
2828 an emergency;
2929 (2) providing security for the district, including:
3030 (A) employing school district peace officers,
3131 private security officers, and school marshals; and
3232 (B) collaborating with local law enforcement
3333 agencies, such as entering into a memorandum of understanding for
3434 the assignment of school resource officers to schools in the
3535 district;
3636 (3) school safety and security training and planning,
3737 including:
3838 (A) active shooter and emergency response
3939 training;
4040 (B) prevention and treatment programs relating
4141 to addressing adverse childhood experiences; and
4242 (C) the prevention, identification, and
4343 management of emergencies and threats, using evidence-based,
4444 effective prevention practices and including:
4545 (i) providing licensed counselors, social
4646 workers, and individuals trained in restorative discipline and
4747 restorative justice practices;
4848 (ii) providing mental health personnel and
4949 support;
5050 (iii) providing behavioral health
5151 services;
5252 (iv) establishing threat reporting
5353 systems; [and]
5454 (v) providing professional development for
5555 educators that includes training in classroom behavioral
5656 management; and
5757 (vi) developing and implementing programs
5858 focused on restorative justice practices, culturally relevant
5959 instruction, and providing mental health support; and
6060 (4) providing programs related to suicide prevention,
6161 intervention, and postvention.
6262 SECTION 2. This Act takes effect September 1, 2023.
