88 AN ACT
99 relating to operating agreements between holders of a distiller's
1010 and rectifier's permit and certain alcoholic beverage permit
1111 holders.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 14, Alcoholic Beverage Code, is amended
1414 by adding Section 14.10 to read as follows:
1515 Sec. 14.10. OPERATING AGREEMENTS BETWEEN PERMIT HOLDERS.
1616 (a) The holder of a distiller's and rectifier's permit may enter
1717 into an agreement with another holder of a distiller's and
1818 rectifier's permit that allows the distiller's and rectifier's
1919 permit holder to engage in the following activities on the
2020 permitted premises of the other distiller's and rectifier's permit
2121 holder:
2222 (1) manufacture distilled spirits;
2323 (2) rectify, purify, and refine distilled spirits and
2424 wines;
2525 (3) mix wines, distilled spirits, or other liquors;
2626 (4) bottle, label, and package the permit holder's
2727 finished products;
2828 (5) sell the finished products in this state to
2929 holders of wholesaler's permits and to authorized wholesalers and
3030 manufacturers outside the state;
3131 (6) sell, through an affiliate who is the holder of a
3232 nonresident seller's permit, the finished products in this state to
3333 holders of wholesaler's permits and to authorized wholesalers and
3434 manufacturers outside the state;
3535 (7) purchase distilled spirits, to be used only for
3636 manufacturing or rectification purposes, from holders of
3737 nonresident seller's permits or distiller's and rectifier's
3838 permits; and
3939 (8) sell bulk alcohol produced by the permit holder
4040 for purposes described by Section 38.01.
4141 (b) The agreement is subject to approval by the commission
4242 and must describe with specificity the nature, duration, and extent
4343 of the activities authorized by the agreement.
4444 (c) The holder of a distiller's and rectifier's permit may
4545 enter into an agreement authorized by Section 37.011 with the
4646 holder of a nonresident seller's permit.
4747 (d) The holder of a distiller's and rectifier's permit on
4848 whose premises another distiller's and rectifier's permit holder
4949 contracts under this section to manufacture, bottle, package, or
5050 label alcoholic beverages may not:
5151 (1) consider or treat the alcoholic beverages
5252 manufactured, bottled, packaged, or labeled under the agreement as
5353 being owned by the permit holder; or
5454 (2) sell those alcoholic beverages on the permit
5555 holder's premises.
5656 (e) The commission shall adopt rules regulating the shared
5757 use of the permitted premises under this section to ensure
5858 administrative accountability of each permit holder and a strict
5959 separation between the businesses and operations of the permit
6060 holders.
6161 SECTION 2. Chapter 37, Alcoholic Beverage Code, is amended
6262 by adding Section 37.011 to read as follows:
6363 Sec. 37.011. OPERATING AGREEMENT WITH IN-STATE DISTILLERY.
6464 (a) The holder of a nonresident seller's permit who owns a
6565 distillery outside of the state or whose affiliate owns a
6666 distillery outside of the state and holds a distiller's and
6767 rectifier's permit may enter into an agreement with the holder of a
6868 distiller's and rectifier's permit that allows the nonresident
6969 seller to engage in the following activities on the distiller's and
7070 rectifier's permitted premises:
7171 (1) manufacture distilled spirits;
7272 (2) rectify, purify, and refine distilled spirits and
7373 wines;
7474 (3) mix wines, distilled spirits, or other liquors;
7575 (4) bottle, label, and package the nonresident
7676 seller's finished products; and
7777 (5) sell the finished products in this state to
7878 holders of distiller's and rectifier's permits and holders of
7979 wholesaler's permits and to authorized wholesalers and
8080 manufacturers outside the state.
8181 (b) The agreement is subject to approval by the commission
8282 and must describe with specificity the nature, duration, and extent
8383 of the activities authorized by the agreement.
8484 (c) The holder of a distiller's and rectifier's permit on
8585 whose premises the holder of a nonresident seller's permit
8686 contracts under this section to manufacture, bottle, package, or
8787 label alcoholic beverages may not:
8888 (1) consider or treat the alcoholic beverages
8989 manufactured, bottled, packaged, or labeled under the agreement as
9090 being owned by the distiller's and rectifier's permit holder; or
9191 (2) sell those alcoholic beverages on the distiller's
9292 and rectifier's permit holder's premises.
9393 (d) The commission shall adopt rules regulating the shared
9494 use of the permitted premises under this section to ensure
9595 administrative accountability of each permit holder and a strict
9696 separation between the businesses and operations of the permit
9797 holders.
9898 SECTION 3. This Act takes effect September 1, 2023.
