| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 382.0162 to read as follows: |

| 12 | 12 | | Sec. 382.0162. MONITORING OF EMISSIONS FROM AGGREGATE OR |
|---|
| 13 | 13 | | CONCRETE FACILITIES. (a) This section applies only to a person who |
|---|
| 14 | 14 | | holds a permit issued under this chapter or is authorized to use a |
|---|
| 15 | 15 | | permit issued under this chapter relating to the operation of a |
|---|
| 16 | 16 | | facility: |
|---|
| 17 | 17 | | (1) used for the production of aggregates, as defined |
|---|
| 18 | 18 | | by Section 28A.001, Water Code; |
|---|
| 19 | 19 | | (2) used for concrete crushing; or |
|---|
| 20 | 20 | | (3) that is a concrete plant that performs wet |
|---|
| 21 | 21 | | batching, dry batching, or central mixing. |
|---|
| 22 | 22 | | (b) The commission by rule shall require a person described |
|---|
| 23 | 23 | | by Subsection (a) to conduct fence-line or property-line monitoring |
|---|
| 24 | 24 | | of emissions of air contaminants from the permitted facility. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
