77 relating to the monitoring of emissions from certain facilities
88 that emit air contaminants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 382, Health and Safety
1111 Code, is amended by adding Section 382.0162 to read as follows:
1212 Sec. 382.0162. MONITORING OF EMISSIONS FROM AGGREGATE OR
1313 CONCRETE FACILITIES. (a) This section applies only to a person who
1414 holds a permit issued under this chapter or is authorized to use a
1515 permit issued under this chapter relating to the operation of a
1616 facility:
1717 (1) used for the production of aggregates, as defined
1818 by Section 28A.001, Water Code;
1919 (2) used for concrete crushing; or
2020 (3) that is a concrete plant that performs wet
2121 batching, dry batching, or central mixing.
2222 (b) The commission by rule shall require a person described
2323 by Subsection (a) to conduct fence-line or property-line monitoring
2424 of emissions of air contaminants from the permitted facility.
2525 SECTION 2. This Act takes effect September 1, 2023.
