6 | 6 | | nonlivestock animals under certain circumstances. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Section 42.092(a), Penal Code, is amended by |
---|
9 | 9 | | adding Subdivisions (9) and (10) to read as follows: |
---|
10 | 10 | | (9) "Trap-Neuter-Return Program" means a nonlethal |
---|
11 | 11 | | population control practice in which an animal is: |
---|
12 | 12 | | (A) trapped; |
---|
13 | 13 | | (B) evaluated by a veterinarian; |
---|
14 | 14 | | (C) if unvaccinated, vaccinated by a |
---|
15 | 15 | | veterinarian; |
---|
16 | 16 | | (D) if unsterilized, sterilized by a |
---|
17 | 17 | | veterinarian; |
---|
18 | 18 | | (E) marked by a veterinarian, whether by notching |
---|
19 | 19 | | or tipping one ear or otherwise; and |
---|
20 | 20 | | (F) returned to the trap location. |
---|
21 | 21 | | (10) "Veterinarian" shall have the same meaning as |
---|
22 | 22 | | set forth in Section 801.002, Occupations Code. |
---|
23 | 23 | | SECTION 2. Section 42.092, Penal Code, is amended by adding |
---|
24 | 24 | | Subsections (e-1) and (e-2) to read as follows: |
---|
25 | 25 | | (e-1) It is a defense to prosecution under Subsection (b)(4) |
---|
26 | 26 | | that the actor released or returned a stray or feral animal which is |
---|
27 | 27 | | not a wild living creature pursuant to a Trap-Neuter-Return |
---|
28 | 28 | | Program. |
---|
29 | 29 | | (e-2) It is a defense to prosecution under Subsection (b)(4) |
---|
30 | 30 | | that the actor released or returned a previously trapped wild |
---|
31 | 31 | | living creature in accordance with Texas wildlife laws and |
---|
32 | 32 | | regulations. |
---|
33 | 33 | | SECTION 3. The change in law made by this Act applies only |
---|
34 | 34 | | to an offense committed on or after the effective date of this Act. |
---|
35 | 35 | | An offense committed before the effective date of this Act is |
---|
36 | 36 | | governed by the law in effect on the date the offense was committed, |
---|
37 | 37 | | and the former law is continued in effect for that purpose. For |
---|
38 | 38 | | purposes of this section, an offense was committed before the |
---|
39 | 39 | | effective date of this Act if any element of the offense occurred |
---|
40 | 40 | | before that date. |
---|
41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2023. |
