44 AN ACT
55 relating to a defense to prosecution for the offense of cruelty to
66 nonlivestock animals under certain circumstances.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 42.092(a), Penal Code, is amended by
99 adding Subdivisions (9) and (10) to read as follows:
1010 (9) "Trap-Neuter-Return Program" means a nonlethal
1111 population control practice in which an animal is:
1212 (A) trapped;
1313 (B) evaluated by a veterinarian;
1414 (C) if unvaccinated, vaccinated by a
1515 veterinarian;
1616 (D) if unsterilized, sterilized by a
1717 veterinarian;
1818 (E) marked by a veterinarian, whether by notching
1919 or tipping one ear or otherwise; and
2020 (F) returned to the trap location.
2121 (10) "Veterinarian" shall have the same meaning as
2222 set forth in Section 801.002, Occupations Code.
2323 SECTION 2. Section 42.092, Penal Code, is amended by adding
2424 Subsections (e-1) and (e-2) to read as follows:
2525 (e-1) It is a defense to prosecution under Subsection (b)(4)
2626 that the actor released or returned a stray or feral animal which is
2727 not a wild living creature pursuant to a Trap-Neuter-Return
2828 Program.
2929 (e-2) It is a defense to prosecution under Subsection (b)(4)
3030 that the actor released or returned a previously trapped wild
3131 living creature in accordance with Texas wildlife laws and
3232 regulations.
3333 SECTION 3. The change in law made by this Act applies only
3434 to an offense committed on or after the effective date of this Act.
3535 An offense committed before the effective date of this Act is
3636 governed by the law in effect on the date the offense was committed,
3737 and the former law is continued in effect for that purpose. For
3838 purposes of this section, an offense was committed before the
3939 effective date of this Act if any element of the offense occurred
4040 before that date.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2023.
