| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 614, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter B-1 to read as follows: |

| 12 | 12 | | SUBCHAPTER B-1. INVESTIGATION OF PEACE OFFICER |
|---|
| 13 | 13 | | Sec. 614.031. INVESTIGATION OF MISCONDUCT. (a) In this |
|---|
| 14 | 14 | | section, "law enforcement agency" means the Department of Public |
|---|
| 15 | 15 | | Safety or an agency of a political subdivision authorized by law to |
|---|
| 16 | 16 | | employ peace officers under Article 2.12, Code of Criminal |
|---|
| 17 | 17 | | Procedure. |
|---|
| 18 | 18 | | (b) A law enforcement agency must permanently maintain in a |
|---|
| 19 | 19 | | peace officer's personnel file the complete record of an internal |
|---|
| 20 | 20 | | investigation of the officer conducted by the agency in response to |
|---|
| 21 | 21 | | a complaint of misconduct. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an investigation of a peace officer that is initiated or pending |
|---|
| 24 | 24 | | on or after the effective date of this Act. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
