| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 66, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended by adding Subchapter E-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER E-1. CUSTODY INFORMATION SYSTEM |
|---|
| 13 | 13 | | Art. 66.221. CUSTODY INFORMATION SYSTEM. (a) The Texas |
|---|
| 14 | 14 | | Department of Criminal Justice shall collaborate with the |
|---|
| 15 | 15 | | Commission on Jail Standards to develop and maintain an online |
|---|
| 16 | 16 | | database for use by judges, prosecutors, and criminal defense |
|---|
| 17 | 17 | | attorneys in this state who are involved in the trial of a criminal |
|---|
| 18 | 18 | | offense. |
|---|
| 19 | 19 | | (b) The custody tracking system shall contain, for each |
|---|
| 20 | 20 | | offender under the supervision of the Texas Department of Criminal |
|---|
| 21 | 21 | | Justice or in the custody of a county jail in this state, the |
|---|
| 22 | 22 | | offender's: |
|---|
| 23 | 23 | | (1) name, including other names by which the offender |
|---|
| 24 | 24 | | is known; |
|---|
| 25 | 25 | | (2) date of birth; |
|---|
| 26 | 26 | | (3) date of arrest; |
|---|
| 27 | 27 | | (4) arrest charge, by offense code; and |
|---|
| 28 | 28 | | (5) date of expected release. |
|---|
| 29 | 29 | | (c) The Texas Department of Criminal Justice shall adopt |
|---|
| 30 | 30 | | rules necessary to implement this section, including rules: |
|---|
| 31 | 31 | | (1) limiting access to the judicial information system |
|---|
| 32 | 32 | | to individuals described by Subsection (a); |
|---|
| 33 | 33 | | (2) providing for the security and confidentiality of |
|---|
| 34 | 34 | | the information maintained in the custody information system; and |
|---|
| 35 | 35 | | (3) requiring the system to be updated in real time to |
|---|
| 36 | 36 | | reflect the location of each offender. |
|---|
| 37 | 37 | | (d) Each county jail in this state shall cooperate with the |
|---|
| 38 | 38 | | Texas Department of Criminal Justice in providing the information |
|---|
| 39 | 39 | | necessary for the department to maintain the custody information |
|---|
| 40 | 40 | | system. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2023. |
