55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the development and maintenance of a custody
88 information system for certain offenders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 66, Code of Criminal Procedure, is
1111 amended by adding Subchapter E-1 to read as follows:
1212 SUBCHAPTER E-1. CUSTODY INFORMATION SYSTEM
1313 Art. 66.221. CUSTODY INFORMATION SYSTEM. (a) The Texas
1414 Department of Criminal Justice shall collaborate with the
1515 Commission on Jail Standards to develop and maintain an online
1616 database for use by judges, prosecutors, and criminal defense
1717 attorneys in this state who are involved in the trial of a criminal
1818 offense.
1919 (b) The custody tracking system shall contain, for each
2020 offender under the supervision of the Texas Department of Criminal
2121 Justice or in the custody of a county jail in this state, the
2222 offender's:
2323 (1) name, including other names by which the offender
2424 is known;
2525 (2) date of birth;
2626 (3) date of arrest;
2727 (4) arrest charge, by offense code; and
2828 (5) date of expected release.
2929 (c) The Texas Department of Criminal Justice shall adopt
3030 rules necessary to implement this section, including rules:
3131 (1) limiting access to the judicial information system
3232 to individuals described by Subsection (a);
3333 (2) providing for the security and confidentiality of
3434 the information maintained in the custody information system; and
3535 (3) requiring the system to be updated in real time to
3636 reflect the location of each offender.
3737 (d) Each county jail in this state shall cooperate with the
3838 Texas Department of Criminal Justice in providing the information
3939 necessary for the department to maintain the custody information
4040 system.
4141 SECTION 2. This Act takes effect September 1, 2023.
