55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the award of time credits to certain persons released on
88 parole or to mandatory supervision.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 508, Government Code, is
1111 amended by adding Section 508.1559 to read as follows:
1212 Sec. 508.1559. TIME CREDITS FOR COMPLETION OF CERTAIN
1313 CONDITIONS OF PAROLE OR MANDATORY SUPERVISION. (a) This section
1414 applies only to a releasee who:
1515 (1) is serving a sentence for an offense punishable as
1616 a felony of the third degree, other than an offense:
1717 (A) included as a reportable conviction or
1818 adjudication under Article 62.001(5), Code of Criminal Procedure;
1919 (B) involving family violence as defined by
2020 Section 71.004, Family Code; or
2121 (C) under Section 20.03, Penal Code; and
2222 (2) has fully satisfied any order to pay restitution
2323 to a victim.
2424 (b) A releasee is entitled to time credits toward the
2525 completion of the releasee's period of parole or mandatory
2626 supervision in an amount equal to seven days for each month in which
2727 the releasee is in compliance with the conditions of the releasee's
2828 parole or mandatory supervision.
2929 (c) In addition to the time credits to which a releasee is
3030 entitled under Subsection (b), a releasee is entitled to receive
3131 any combination of time credits toward the completion of the
3232 releasee's period of parole or mandatory supervision in accordance
3333 with Subsections (d), (e), and (f) if the releasee was required as a
3434 condition of parole or mandatory supervision to:
3535 (1) make a payment described by Subsection (d);
3636 (2) complete a treatment or rehabilitation program
3737 described by Subsection (e); or
3838 (3) earn a diploma, certificate, or degree described
3939 by Subsection (f).
4040 (d) A releasee is entitled to time credits toward the
4141 completion of the releasee's period of parole or mandatory
4242 supervision for the full payment of court costs, fines, attorney's
4343 fees, and restitution as follows:
4444 (1) court costs: 15 days;
4545 (2) fines: 30 days;
4646 (3) attorney's fees: 30 days; and
4747 (4) restitution: 60 days.
4848 (e) A releasee is entitled to time credits toward the
4949 completion of the releasee's period of parole or mandatory
5050 supervision for the successful completion of treatment or
5151 rehabilitation programs as follows:
5252 (1) parenting class or parental responsibility
5353 program: 30 days;
5454 (2) anger management program: 30 days;
5555 (3) life skills training program: 30 days;
5656 (4) vocational, technical, or career education or
5757 training program: 60 days;
5858 (5) alcohol or substance abuse counseling or
5959 treatment: 90 days;
6060 (6) mental health program: 90 days; and
6161 (7) any other faith-based, volunteer, or
6262 community-based program ordered or approved by the parole panel: 30
6363 days.
6464 (f) A releasee is entitled to time credits toward the
6565 completion of the releasee's period of parole or mandatory
6666 supervision for earning the following diplomas, certificates, or
6767 degrees:
6868 (1) a high school diploma or high school equivalency
6969 certificate: 90 days; and
7070 (2) an associate degree: 120 days.
7171 (g) If a releasee's parole or mandatory supervision is
7272 revoked, all of the time credits to which the releasee is entitled
7373 under this section are forfeited and may not be credited toward the
7474 remaining portion of the releasee's sentence.
7575 SECTION 2. The change in law made by this Act applies only
7676 to a person who is released on parole or to mandatory supervision
7777 for an offense committed on or after the effective date of this Act.
7878 A person who is released on parole or to mandatory supervision for
7979 an offense committed before the effective date of this Act is
8080 governed by the law in effect on the date the offense was committed,
8181 and the former law is continued in effect for that purpose. For
8282 purposes of this section, an offense was committed before the
8383 effective date of this Act if any element of the offense occurred
8484 before that date.
8585 SECTION 3. This Act takes effect September 1, 2023.
