7	7	relating to the use by a public institution of higher education of
8	8	money appropriated to the institution by the legislature as part of
9	9	an across-the-board salary increase for state employees.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 51.0065, Education Code, is amended to
12	12	read as follows:
13	13	Sec. 51.0065. APPLICABILITY OF ACROSS-THE-BOARD SALARY
14	14	INCREASE. An institution of higher education that receives an
15	15	appropriation from the legislature made as part of [has adopted a
16	16	pay-for-performance program that is in effect when] an
17	17	across-the-board salary increase for state employees may use the
18	18	appropriated amount only [made by an appropriation act of the
19	19	legislature takes effect is entitled to receive any appropriation
20	20	made] for purposes of the across-the-board salary increase,

28	28	provided by Section 39, Article III, Texas Constitution. If this
29	29	Act does not receive the vote necessary for immediate effect, this
30	30	Act takes effect September 1, 2023.
