66 AN ACT
77 relating to the Department of Family and Protective Services'
88 annual report of key performance measures and data elements for
99 child protection; authorizing a penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 264.017, Family Code, is amended by
1212 amending Subsection (b) and adding Subsection (f) to read as
1313 follows:
1414 (b) The department shall provide the report required by
1515 Subsection (a) to the legislature and shall publish the report and
1616 make the report available electronically to the public, including
1717 by posting the report on the department's Internet website, not
1818 later than February 1 of each year. The report must include, with
1919 respect to the preceding year:
2020 (1) information on the number and disposition of
2121 reports of child abuse and neglect received by the department;
2222 (2) information on the number of clients for whom the
2323 department took protective action, including investigations,
2424 alternative responses, and court-ordered removals;
2525 (3) information on the number of clients for whom the
2626 department provided services in each program administered by the
2727 child protective services division, including investigations,
2828 alternative responses, family-based safety services,
2929 conservatorship, post-adoption services, and transitional living
3030 services;
3131 (4) the number of children in this state who died as a
3232 result of child abuse or neglect;
3333 (5) the number of children described by Subdivision
3434 (4) for whom the department was the children's managing conservator
3535 at the time of death;
3636 (6) information on the timeliness of the department's
3737 initial contact in an investigation or alternative response;
3838 (7) information on the response time by the department
3939 in commencing services to families and children for whom an
4040 allegation of child abuse or neglect has been made;
4141 (8) information regarding child protection staffing
4242 and caseloads by program area;
4343 (9) information on the permanency goals in place and
4444 achieved for children in the managing conservatorship of the
4545 department, including information on the timeliness of achieving
4646 the goals, the stability of the children's placement in foster
4747 care, and the proximity of placements to the children's home
4848 counties;
4949 (10) the number of children who suffer from a severe
5050 emotional disturbance and for whom the department is appointed
5151 managing conservator, including statistics on appointments as
5252 joint managing conservator, due to an individual voluntarily
5353 relinquishing custody of a child solely to obtain mental health
5454 services for the child;
5555 (11) the number of children who are pregnant or a
5656 parent while in the managing conservatorship of the department and
5757 the number of the children born to a parent in the managing
5858 conservatorship of the department who are placed in the managing
5959 conservatorship of the department;
6060 (12) the number of children who are missing from the
6161 children's substitute care provider while in the managing
6262 conservatorship of the department; [and]
6363 (13) the number of children who were victims of
6464 trafficking under Chapter 20A, Penal Code, while in the managing
6565 conservatorship of the department; and
6666 (14) information on the state's kinship care program.
6767 (f) The comptroller shall assess a penalty against the
6868 department in the amount of $1,000 for each day after February 1 the
6969 department has not filed the report under Subsection (b). The
7070 comptroller shall reallocate the amount assessed as a penalty under
7171 this subsection as necessary to allow the department to use the
7272 money to provide financial assistance to relative and other
7373 designated caregivers under Section 264.755.
7474 SECTION 2. This Act takes effect September 1, 2023.
