55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a deadline for completing services under a family
88 service plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 263.102, Family Code, is amended by
1111 amending Subsection (a) and adding Subsection (e-1) to read as
1212 follows:
1313 (a) The service plan must:
1414 (1) be specific;
1515 (2) be in writing in a language that the parents
1616 understand, or made otherwise available;
1717 (3) be prepared by the department in conference with
1818 the child's parents;
1919 (4) state appropriate deadlines;
2020 (5) specify the primary permanency goal and at least
2121 one alternative permanency goal;
2222 (6) state steps that are necessary to:
2323 (A) return the child to the child's home if the
2424 placement is in foster care;
2525 (B) enable the child to remain in the child's
2626 home with the assistance of a service plan if the placement is in
2727 the home under the department's supervision; or
2828 (C) otherwise provide a permanent safe placement
2929 for the child;
3030 (7) state the actions and responsibilities that are
3131 necessary for the child's parents to take to achieve the plan goal
3232 during the period of the service plan and the assistance to be
3333 provided to the parents by the department or other agency toward
3434 meeting that goal;
3535 (8) state any specific skills or knowledge that the
3636 child's parents must acquire or learn, as well as any behavioral
3737 changes the parents must exhibit, to achieve the plan goal;
3838 (9) state the actions and responsibilities that are
3939 necessary for the child's parents to take to ensure that the child
4040 attends school and maintains or improves the child's academic
4141 compliance;
4242 (10) state the name of the person with the department
4343 whom the child's parents may contact for information relating to
4444 the child if other than the person preparing the plan; [and]
4545 (11) prescribe any other term or condition that the
4646 department determines to be necessary to the service plan's
4747 success; and
4848 (12) describe any services the department will provide
4949 under Subsection (e).
5050 (e-1) Services provided by the department under Subsection
5151 (e) must be concluded not later than the 15th business day before
5252 the dismissal date for the suit as provided by Subchapter E.
5353 SECTION 2. The change in law made by this Act applies only
5454 to a service plan that is created on or after the effective date of
5555 this Act. A service plan that is created before the effective date
5656 of this Act is governed by the law in effect on the date the service
5757 plan was created, and the former law is continued in effect for that
5858 purpose.
5959 SECTION 3. This Act takes effect September 1, 2023.
