7 | 7 | | relating to a deadline for completing services under a family |
---|
8 | 8 | | service plan. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 263.102, Family Code, is amended by |
---|
11 | 11 | | amending Subsection (a) and adding Subsection (e-1) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) The service plan must: |
---|
14 | 14 | | (1) be specific; |
---|
15 | 15 | | (2) be in writing in a language that the parents |
---|
16 | 16 | | understand, or made otherwise available; |
---|
17 | 17 | | (3) be prepared by the department in conference with |
---|
18 | 18 | | the child's parents; |
---|
19 | 19 | | (4) state appropriate deadlines; |
---|
20 | 20 | | (5) specify the primary permanency goal and at least |
---|
21 | 21 | | one alternative permanency goal; |
---|
22 | 22 | | (6) state steps that are necessary to: |
---|
23 | 23 | | (A) return the child to the child's home if the |
---|
24 | 24 | | placement is in foster care; |
---|
25 | 25 | | (B) enable the child to remain in the child's |
---|
26 | 26 | | home with the assistance of a service plan if the placement is in |
---|
27 | 27 | | the home under the department's supervision; or |
---|
28 | 28 | | (C) otherwise provide a permanent safe placement |
---|
29 | 29 | | for the child; |
---|
30 | 30 | | (7) state the actions and responsibilities that are |
---|
31 | 31 | | necessary for the child's parents to take to achieve the plan goal |
---|
32 | 32 | | during the period of the service plan and the assistance to be |
---|
33 | 33 | | provided to the parents by the department or other agency toward |
---|
34 | 34 | | meeting that goal; |
---|
35 | 35 | | (8) state any specific skills or knowledge that the |
---|
36 | 36 | | child's parents must acquire or learn, as well as any behavioral |
---|
37 | 37 | | changes the parents must exhibit, to achieve the plan goal; |
---|
38 | 38 | | (9) state the actions and responsibilities that are |
---|
39 | 39 | | necessary for the child's parents to take to ensure that the child |
---|
40 | 40 | | attends school and maintains or improves the child's academic |
---|
41 | 41 | | compliance; |
---|
42 | 42 | | (10) state the name of the person with the department |
---|
43 | 43 | | whom the child's parents may contact for information relating to |
---|
44 | 44 | | the child if other than the person preparing the plan; [and] |
---|
45 | 45 | | (11) prescribe any other term or condition that the |
---|
46 | 46 | | department determines to be necessary to the service plan's |
---|
47 | 47 | | success; and |
---|
48 | 48 | | (12) describe any services the department will provide |
---|
49 | 49 | | under Subsection (e). |
---|
50 | 50 | | (e-1) Services provided by the department under Subsection |
---|
51 | 51 | | (e) must be concluded not later than the 15th business day before |
---|
52 | 52 | | the dismissal date for the suit as provided by Subchapter E. |
---|
53 | 53 | | SECTION 2. The change in law made by this Act applies only |
---|
54 | 54 | | to a service plan that is created on or after the effective date of |
---|
55 | 55 | | this Act. A service plan that is created before the effective date |
---|
56 | 56 | | of this Act is governed by the law in effect on the date the service |
---|
57 | 57 | | plan was created, and the former law is continued in effect for that |
---|
58 | 58 | | purpose. |
---|
59 | 59 | | SECTION 3. This Act takes effect September 1, 2023. |
