55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority to issue a citation in lieu of arrest for
88 certain Class A and B misdemeanors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 14.06(c), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (c) If the person resides in this state [the county where
1313 the offense occurred], a peace officer who is charging a person with
1414 committing an offense that is a Class A or B misdemeanor may,
1515 instead of taking the person before a magistrate, issue a citation
1616 to the person that contains written notice of the time and place the
1717 person must appear before a magistrate of this state as described by
1818 Subsection (a), the name and address of the person charged, and the
1919 offense charged.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 3. This Act takes effect September 1, 2023.
