| 7 | 7 | | relating to the titling, registration, and operation of an |

| 8 | 8 | | autocycle. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 501.008(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) In this section, "autocycle" means a motor vehicle, |
|---|
| 13 | 13 | | other than a tractor, that is: |
|---|
| 14 | 14 | | (1) designed to have when propelled not more than |
|---|
| 15 | 15 | | three wheels on the ground; |
|---|
| 16 | 16 | | (2) equipped with seat belts and a steering mechanism |
|---|
| 17 | 17 | | [wheel]; |
|---|
| 18 | 18 | | (3) equipped with seating that does not require the |
|---|
| 19 | 19 | | operator to straddle or sit astride the seat; and |
|---|
| 20 | 20 | | (4) manufactured and certified to comply with federal |
|---|
| 21 | 21 | | safety requirements for a motorcycle. |
|---|
| 22 | 22 | | SECTION 2. Section 502.005(a), Transportation Code, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | (a) In this section, "autocycle" means a motor vehicle, |

| 25 | 25 | | other than a tractor, that is: |
|---|

| 36 | 36 | | Sec. 661.0015. PROTECTIVE HEADGEAR FOR AUTOCYCLE. (a) In |

| 37 | 37 | | this section, "autocycle" means a motor vehicle, other than a |
|---|
| 38 | 38 | | tractor, that is: |
|---|
| 39 | 39 | | (1) designed to have when propelled not more than |
|---|
| 40 | 40 | | three wheels on the ground; |
|---|
| 41 | 41 | | (2) equipped with seat belts and a steering mechanism |
|---|
| 42 | 42 | | [wheel]; |
|---|
| 43 | 43 | | (3) equipped with seating that does not require the |
|---|
| 44 | 44 | | operator to straddle or sit astride the seat; and |
|---|
| 45 | 45 | | (4) manufactured and certified to comply with federal |
|---|
| 46 | 46 | | safety requirements for a motorcycle. |

| 47 | 47 | | (b) For purposes of this chapter, an autocycle is considered |
|---|
| 48 | 48 | | to be a motorcycle, except that this chapter does not apply to an |
|---|
| 49 | 49 | | autocycle that has a partially or fully enclosed cab. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2023. |
