99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the date of runoff elections.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2.025, Election Code, is amended by
1414 amending Subsection (a) and adding Subsection (e) to read as
1515 follows:
1616 (a) Except as provided by Subsection (d) or as otherwise
1717 provided by this code, a runoff election shall be held on a Saturday
1818 designated by the secretary of state [not earlier than the 20th or
1919 later than the 45th day after the date the final canvass of the main
2020 election is completed].
2121 (e) A date designated by the secretary of state under this
2222 section for a runoff election:
2323 (1) must be:
2424 (A) not earlier than the 30th day after the date
2525 of the main election; and
2626 (B) not later than the 45th day after the date of
2727 the main election; and
2828 (2) may not:
2929 (A) be a national or state holiday under Section
3030 1.006(f); or
3131 (B) have an early voting period that includes a
3232 national or state holiday under Section 1.006(f).
3333 SECTION 2. Section 2.025(b), Election Code, is repealed.
3434 SECTION 3. This Act takes effect September 1, 2023.
