| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 102.02, Alcoholic Beverage Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 102.02. PROVIDING SAMPLES. (a) Notwithstanding any |
|---|
| 11 | 11 | | other provision of this code, the holder of a wholesaler's permit or |
|---|
| 12 | 12 | | distributor's license or the holder's agent, representative, or |
|---|
| 13 | 13 | | employee may furnish or give a sample of liquor or malt beverages to |
|---|
| 14 | 14 | | a holder of a permit or license authorizing the sale of that |
|---|
| 15 | 15 | | category of alcoholic beverage at retail if the retail permittee or |
|---|
| 16 | 16 | | licensee has not previously purchased that brand from that |
|---|
| 17 | 17 | | wholesaler permittee or distributor licensee. |
|---|
| 18 | 18 | | (b) The liquor or malt beverages provided as a sample under |
|---|
| 19 | 19 | | Subsection (a) [wholesaler] may [give the retail permittee] not be |
|---|
| 20 | 20 | | more than: |
|---|
| 21 | 21 | | (1) 750 milliliters of any brand of distilled spirits; |
|---|
| 22 | 22 | | (2) [, not more than] three liters of any brand of |
|---|
| 23 | 23 | | wine; and |
|---|
| 24 | 24 | | (3) 72 ounces [in that package, and not more than one |
|---|
| 25 | 25 | | six-pack] of any brand of malt [other alcoholic] beverage [so |
|---|
| 26 | 26 | | packaged]. |
|---|
| 27 | 27 | | (c) The holder of a retail permit or license authorizing the |
|---|
| 28 | 28 | | sale of liquor or malt beverages [permittee] or the permittee's or |
|---|
| 29 | 29 | | licensee's agent, servant, or employee may sample the alcoholic |
|---|
| 30 | 30 | | beverage provided under Subsection (a) [the product] on the |
|---|
| 31 | 31 | | permitted or licensed retail [licensed] premises only if: |
|---|
| 32 | 32 | | (1) the holder of the wholesaler's permit or |
|---|
| 33 | 33 | | distributor's license is present; [wholesaler] or |
|---|
| 34 | 34 | | (2) the wholesaler's or distributor's agent, servant, |
|---|
| 35 | 35 | | or employee is present. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2023. |
