| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle A, Title 4, Health and Safety Code, is |

| 11 | 11 | | amended by adding Chapter 226 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 226. LONG-TERM CARE FACILITY RESIDENT RIGHT TO ACCESS |
|---|
| 13 | 13 | | PRESCRIPTION MEDICATION |
|---|
| 14 | 14 | | Sec. 226.001. DEFINITIONS. In this chapter: |
|---|
| 15 | 15 | | (1) "Long-term care facility" means: |
|---|
| 16 | 16 | | (A) a facility licensed or regulated under |
|---|
| 17 | 17 | | Chapter 242, 247, or 252, Health and Safety Code; or |
|---|
| 18 | 18 | | (B) a state supported living center as defined by |
|---|
| 19 | 19 | | Section 531.002, Health and Safety Code. |
|---|
| 20 | 20 | | (2) "Prescription" includes an entry in the |
|---|
| 21 | 21 | | compassionate-use registry established under Section 487.054. |
|---|
| 22 | 22 | | Sec. 226.002. RESIDENT RIGHT TO ACCESS PRESCRIPTION |
|---|
| 23 | 23 | | MEDICATION. A resident of a long-term care facility has a right to |
|---|
| 24 | 24 | | access any medication for which the resident has a prescription |
|---|
| 25 | 25 | | from a licensed practitioner, including a medication containing |
|---|
| 26 | 26 | | low-THC cannabis. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
