77 relating to access to all prescribed medications by residents in
88 certain long-term care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 4, Health and Safety Code, is
1111 amended by adding Chapter 226 to read as follows:
1212 CHAPTER 226. LONG-TERM CARE FACILITY RESIDENT RIGHT TO ACCESS
1313 PRESCRIPTION MEDICATION
1414 Sec. 226.001. DEFINITIONS. In this chapter:
1515 (1) "Long-term care facility" means:
1616 (A) a facility licensed or regulated under
1717 Chapter 242, 247, or 252, Health and Safety Code; or
1818 (B) a state supported living center as defined by
1919 Section 531.002, Health and Safety Code.
2020 (2) "Prescription" includes an entry in the
2121 compassionate-use registry established under Section 487.054.
2222 Sec. 226.002. RESIDENT RIGHT TO ACCESS PRESCRIPTION
2323 MEDICATION. A resident of a long-term care facility has a right to
2424 access any medication for which the resident has a prescription
2525 from a licensed practitioner, including a medication containing
2626 low-THC cannabis.
2727 SECTION 2. This Act takes effect September 1, 2023.
