55 AN ACT
66 relating to the authorization of certain adult high school charter
77 school programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter G, Chapter 12, Education Code, is
1010 amended by adding Section 12.2551 to read as follows:
1111 Sec. 12.2551. ALTERNATIVE AUTHORIZATION. (a)
1212 Notwithstanding any other law and in addition to the other
1313 permissible methods for establishing a charter or campus under this
1414 chapter, the commissioner shall, on the basis of an application
1515 submitted, grant a charter under the program to the entities
1616 described by Subsection (b) to provide an adult education program
1717 for individuals described by Section 12.258 to successfully
1818 complete:
1919 (1) a high school program that can lead to a diploma;
2020 and
2121 (2) career and technology education courses that can
2222 lead to industry certification.
2323 (b) The following entities are eligible to submit an
2424 application under Subsection (a):
2525 (1) the board of trustees of a school district or the
2626 governing body of a home-rule school district that has entered into
2727 a contract under Section 11.157 with a nonprofit entity described
2828 by Section 12.256 to operate the program;
2929 (2) a public junior college or public senior college
3030 or university, as those terms are defined by Section 61.003, that
3131 has entered into a contract with a nonprofit entity described by
3232 Section 12.256 to operate the program; and
3333 (3) a governmental entity that has entered into a
3434 contract with a nonprofit entity described by Section 12.256 to
3535 operate the program.
3636 (c) The provisions of this chapter, including provisions
3737 related to assessment, accountability, and funding, govern a
3838 program authorized under this section.
3939 (d) The provisions of Section 12.255 do not apply to a
4040 charter granted under this section.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2023.
