| 6 | 6 | | relating to the authorization of certain adult high school charter |

| 7 | 7 | | school programs. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter G, Chapter 12, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 12.2551 to read as follows: |
|---|
| 11 | 11 | | Sec. 12.2551. ALTERNATIVE AUTHORIZATION. (a) |
|---|
| 12 | 12 | | Notwithstanding any other law and in addition to the other |
|---|
| 13 | 13 | | permissible methods for establishing a charter or campus under this |
|---|
| 14 | 14 | | chapter, the commissioner shall, on the basis of an application |
|---|
| 15 | 15 | | submitted, grant a charter under the program to the entities |
|---|
| 16 | 16 | | described by Subsection (b) to provide an adult education program |
|---|
| 17 | 17 | | for individuals described by Section 12.258 to successfully |
|---|
| 18 | 18 | | complete: |
|---|
| 19 | 19 | | (1) a high school program that can lead to a diploma; |
|---|
| 20 | 20 | | and |
|---|
| 21 | 21 | | (2) career and technology education courses that can |
|---|
| 22 | 22 | | lead to industry certification. |
|---|
| 23 | 23 | | (b) The following entities are eligible to submit an |
|---|
| 24 | 24 | | application under Subsection (a): |
|---|
| 25 | 25 | | (1) the board of trustees of a school district or the |
|---|
| 26 | 26 | | governing body of a home-rule school district that has entered into |
|---|
| 27 | 27 | | a contract under Section 11.157 with a nonprofit entity described |
|---|
| 28 | 28 | | by Section 12.256 to operate the program; |
|---|
| 29 | 29 | | (2) a public junior college or public senior college |
|---|
| 30 | 30 | | or university, as those terms are defined by Section 61.003, that |
|---|
| 31 | 31 | | has entered into a contract with a nonprofit entity described by |
|---|
| 32 | 32 | | Section 12.256 to operate the program; and |
|---|
| 33 | 33 | | (3) a governmental entity that has entered into a |
|---|
| 34 | 34 | | contract with a nonprofit entity described by Section 12.256 to |
|---|
| 35 | 35 | | operate the program. |
|---|
| 36 | 36 | | (c) The provisions of this chapter, including provisions |
|---|
| 37 | 37 | | related to assessment, accountability, and funding, govern a |
|---|
| 38 | 38 | | program authorized under this section. |
|---|
| 39 | 39 | | (d) The provisions of Section 12.255 do not apply to a |
|---|
| 40 | 40 | | charter granted under this section. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2023. |
