55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibition on a political subdivision limiting or
88 prohibiting a school activity or service in response to the
99 COVID-19 pandemic.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter E, Chapter 418, Government Code, is
1212 amended by adding Section 418.1087 to read as follows:
1313 Sec. 418.1087. BAN ON COVID-19-RELATED SCHOOL CLOSURES OR
1414 LIMITATIONS. The governing body of a political subdivision or its
1515 presiding officer may not issue an order, enact an ordinance, or
1616 take any other action that would limit or prohibit any school
1717 activity or service in response to the COVID-19 pandemic.
1818 SECTION 2. This Act applies beginning with the 2023-2024
1919 school year.
2020 SECTION 3. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2023.
