55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an opioid-related drug overdose response protocol and
88 training on the administration of an opioid antagonist for public
99 school personnel.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1212 amended by adding Section 38.0301 to read as follows:
1313 Sec. 38.0301. OPIOID-RELATED DRUG OVERDOSE RESPONSE
1414 PROTOCOL. (a) In this section, "opioid antagonist" and
1515 "opioid-related drug overdose" have the meanings assigned by
1616 Section 483.101, Health and Safety Code.
1717 (b) Each school district and open-enrollment charter school
1818 shall develop and annually make available a protocol for school
1919 employees to follow in the event a person at a campus of the
2020 district or school experiences what is reasonably believed to be an
2121 opioid-related drug overdose.
2222 (c) The protocol adopted under this section must:
2323 (1) provide for information about the availability of
2424 opioid antagonists at each district or school campus; and
2525 (2) require that agency-approved training in the use
2626 of opioid antagonists is provided to any school employee who may be
2727 reasonably expected to administer an opioid antagonist to a person
2828 who is reasonably believed to be experiencing an opioid-related
2929 drug overdose at a district or school campus.
3030 (d) The training required under Subsection (c)(2) may be
3131 provided as an online course.
3232 SECTION 2. This Act applies beginning with the 2023-2024
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
