77 relating to facilities included in the electricity supply chain.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 37.157, Utilities Code, is amended to
1010 read as follows:
1111 Sec. 37.157. MAPS. (a) An electric utility shall file with
1212 the commission one or more maps that show each utility facility and
1313 that separately illustrate each utility facility for the
1414 generation, transmission, or distribution of the utility's
1515 services on a date the commission orders.
1616 (b) Each electric utility and municipally owned utility
1717 shall provide the utility's service area boundary map in a
1818 geographic information system format to the commission. The service
1919 area boundary map may be provided to the commission in a geodatabase
2020 feature class or shapefile.
2121 SECTION 2. Section 38.201, Utilities Code, is amended by
2222 amending Subsections (a), (b), and (c) and adding Subsection (a-1)
2323 to read as follows:
2424 (a) In this subchapter, "electricity supply chain" means:
2525 (1) facilities and methods used for producing,
2626 treating, processing, pressurizing, storing, or transporting
2727 natural gas for delivery to electric generation facilities; [and]
2828 (2) critical infrastructure necessary to maintain
2929 electricity service; and
3030 (3) roads necessary to access facilities in the
3131 electricity supply chain.
3232 (a-1) A reference in this subchapter to the "electricity
3333 supply chain" includes water and wastewater treatment plants.
3434 (b) The Texas Electricity Supply Chain Security and Mapping
3535 Committee is established to:
3636 (1) map this state's electricity supply chain;
3737 (2) identify critical infrastructure sources in the
3838 electricity supply chain;
3939 (3) establish best practices to prepare facilities
4040 [that provide electric service and natural gas service] in the
4141 electricity supply chain to maintain service in an extreme weather
4242 event and recommend oversight and compliance standards for those
4343 facilities; and
4444 (4) designate priority service needs to prepare for,
4545 respond to, and recover from an extreme weather event.
4646 (c) The committee is composed of:
4747 (1) the executive director of the commission;
4848 (2) the executive director of the Railroad Commission
4949 of Texas;
5050 (3) the president and the chief executive officer of
5151 the independent organization certified under Section 39.151 for the
5252 ERCOT power region; [and]
5353 (4) the chief of the Texas Division of Emergency
5454 Management; and
5555 (5) the executive director of the Texas Department of
5656 Transportation.
5757 SECTION 3. Section 38.202(c), Utilities Code, is amended to
5858 read as follows:
5959 (c) The commission, the Railroad Commission of Texas, [and]
6060 the Texas Division of Emergency Management, and the Texas
6161 Department of Transportation shall provide staff as necessary to
6262 assist the committee in carrying out the committee's duties and
6363 responsibilities.
6464 SECTION 4. Section 38.203, Utilities Code, is amended by
6565 amending Subsection (a) and adding Subsections (f), (g), (h), and
6666 (i) to read as follows:
6767 (a) The committee shall:
6868 (1) map the state's electricity supply chain in order
6969 to designate priority electricity service needs during extreme
7070 weather events;
7171 (2) identify and designate the sources in the
7272 electricity supply chain necessary to operate critical
7373 infrastructure, as defined by Section 421.001, Government Code;
7474 (3) develop a communication system between critical
7575 infrastructure sources, the commission, and the independent
7676 organization certified under Section 39.151 for the ERCOT power
7777 region to ensure that electricity and natural gas supplies in the
7878 electricity supply chain are prioritized to those sources during an
7979 extreme weather event; and
8080 (4) establish best practices to prepare facilities
8181 [that provide electric service and natural gas service] in the
8282 electricity supply chain to maintain service in an extreme weather
8383 event and recommend oversight and compliance standards for those
8484 facilities.
8585 (f) On request, the committee shall provide view-only
8686 access to the electricity supply chain map to:
8787 (1) an electric utility, a transmission and
8888 distribution utility, an electric cooperative, or a municipally
8989 owned utility;
9090 (2) an operator of a gas supply chain facility, as
9191 defined by Section 86.044, Natural Resources Code; or
9292 (3) an operator of a gas pipeline facility described
9393 by Section 121.2015.
9494 (g) Access to the electricity supply chain map by an entity
9595 described by Subsection (f)(1) is limited to the critical natural
9696 gas facilities on the map that are located in the requesting
9797 entity's service area.
9898 (h) The committee may not provide an entity described by
9999 Subsection (f)(1) with access to the electricity supply chain map
100100 unless the entity has complied with Section 37.157.
101101 (i) Access to the electricity supply chain map by an
102102 operator described by Subsections (f)(2) and (3) is limited to the
103103 critical natural gas facilities owned by the requesting operator.
104104 SECTION 5. The Public Utility Commission of Texas shall
105105 require each entity to which Section 37.157(b), Utilities Code, as
106106 added by this Act, applies to comply with that section not later
107107 than September 30, 2023.
108108 SECTION 6. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2023.
