| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 2052.254, Occupations Code, is amended |
|---|
| 16 | 16 | | to read as follows: |
|---|
| 17 | 17 | | Sec. 2052.254. ELIMINATION TOURNAMENTS. Except as |
|---|
| 18 | 18 | | authorized by commission rule, an [An] elimination tournament may |
|---|
| 19 | 19 | | not be conducted in this state. |
|---|
| 20 | 20 | | SECTION 2. Subchapter F, Chapter 2052, Occupations Code, is |
|---|
| 21 | 21 | | amended by adding Section 2052.255 to read as follows: |
|---|
| 22 | 22 | | Sec. 2052.255. IMMUNITY FOR RINGSIDE PHYSICIANS. A |
|---|
| 23 | 23 | | ringside physician is immune from civil liability arising from acts |
|---|
| 24 | 24 | | within the scope of the physician's responsibilities if the |
|---|
| 25 | 25 | | physician acted in good faith and without malice. |
|---|
| 26 | 26 | | SECTION 3. Section 2052.255, Occupations Code, as added by |
|---|
| 27 | 27 | | this Act, applies only to an action commenced on or after the |
|---|
| 28 | 28 | | effective date of this Act. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
