99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the regulation of combative sports by the Texas
1212 Department of Licensing and Regulation and to immunity for ringside
1313 physicians assigned to combative sports events.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 2052.254, Occupations Code, is amended
1616 to read as follows:
1717 Sec. 2052.254. ELIMINATION TOURNAMENTS. Except as
1818 authorized by commission rule, an [An] elimination tournament may
1919 not be conducted in this state.
2020 SECTION 2. Subchapter F, Chapter 2052, Occupations Code, is
2121 amended by adding Section 2052.255 to read as follows:
2222 Sec. 2052.255. IMMUNITY FOR RINGSIDE PHYSICIANS. A
2323 ringside physician is immune from civil liability arising from acts
2424 within the scope of the physician's responsibilities if the
2525 physician acted in good faith and without malice.
2626 SECTION 3. Section 2052.255, Occupations Code, as added by
2727 this Act, applies only to an action commenced on or after the
2828 effective date of this Act.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
