55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal penalty for the offense of the
88 unauthorized reproduction, purchase, use, sale, or possession of a
99 temporary tag; creating a criminal offense; increasing criminal
1010 penalties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 503.067, Transportation
1313 Code, is amended to read as follows:
1414 Sec. 503.067. UNAUTHORIZED REPRODUCTION, PURCHASE, USE,
1515 [OR] SALE, OR POSSESSION OF TEMPORARY TAGS.
1616 SECTION 2. Section 503.067, Transportation Code, is amended
1717 by adding Subsection (a-1) to read as follows:
1818 (a-1) A person may not possess an unauthorized temporary
1919 tag.
2020 SECTION 3. Section 503.094(d), Transportation Code, is
2121 amended to read as follows:
2222 (d) An offense involving a violation of:
2323 (1) Section 503.067(c) [503.067(b) or (c)] is a Class
2424 C misdemeanor;
2525 (2) Section 503.067(a-1) or (b) [503.067(d)] is a
2626 Class A misdemeanor;
2727 (3) [Section 503.067(a) is a state jail felony; and
2828 [(4)] Section 503.067(b) or [,] (c)[, or (d)] is a
2929 state jail felony if the person who committed the offense
3030 criminally conspired to engage in organized criminal activity; and
3131 (4) Section 503.067(a) or (d) is a felony of the third
3232 degree.
3333 SECTION 4. The change in law made by this Act applies only
3434 to an offense committed on or after the effective date of this Act.
3535 An offense committed before the effective date of this Act is
3636 governed by the law in effect when the offense was committed, and
3737 the former law is continued in effect for that purpose. For
3838 purposes of this section, an offense was committed before the
3939 effective date of this Act if any element of the offense occurred
4040 before that date.
4141 SECTION 5. This Act takes effect September 1, 2023.
