| 8 | 8 | | unauthorized reproduction, purchase, use, sale, or possession of a |

| 9 | 9 | | temporary tag; creating a criminal offense; increasing criminal |
|---|
| 10 | 10 | | penalties. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 503.067, Transportation |
|---|
| 13 | 13 | | Code, is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 503.067. UNAUTHORIZED REPRODUCTION, PURCHASE, USE, |
|---|
| 15 | 15 | | [OR] SALE, OR POSSESSION OF TEMPORARY TAGS. |
|---|
| 16 | 16 | | SECTION 2. Section 503.067, Transportation Code, is amended |
|---|
| 17 | 17 | | by adding Subsection (a-1) to read as follows: |
|---|
| 18 | 18 | | (a-1) A person may not possess an unauthorized temporary |
|---|
| 19 | 19 | | tag. |
|---|
| 20 | 20 | | SECTION 3. Section 503.094(d), Transportation Code, is |
|---|
| 21 | 21 | | amended to read as follows: |
|---|
| 22 | 22 | | (d) An offense involving a violation of: |
|---|
| 23 | 23 | | (1) Section 503.067(c) [503.067(b) or (c)] is a Class |
|---|
| 24 | 24 | | C misdemeanor; |
|---|
| 25 | 25 | | (2) Section 503.067(a-1) or (b) [503.067(d)] is a |
|---|
| 26 | 26 | | Class A misdemeanor; |
|---|
| 27 | 27 | | (3) [Section 503.067(a) is a state jail felony; and |
|---|
| 28 | 28 | | [(4)] Section 503.067(b) or [,] (c)[, or (d)] is a |
|---|
| 29 | 29 | | state jail felony if the person who committed the offense |
|---|
| 30 | 30 | | criminally conspired to engage in organized criminal activity; and |
|---|
| 31 | 31 | | (4) Section 503.067(a) or (d) is a felony of the third |
|---|
| 32 | 32 | | degree. |
|---|
| 33 | 33 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to an offense committed on or after the effective date of this Act. |
|---|
| 35 | 35 | | An offense committed before the effective date of this Act is |
|---|
| 36 | 36 | | governed by the law in effect when the offense was committed, and |
|---|
| 37 | 37 | | the former law is continued in effect for that purpose. For |
|---|
| 38 | 38 | | purposes of this section, an offense was committed before the |
|---|
| 39 | 39 | | effective date of this Act if any element of the offense occurred |
|---|
| 40 | 40 | | before that date. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2023. |
