55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the release and inclusion of extraterritorial
88 jurisdiction by a municipality involving certain areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 42, Local Government Code,
1111 is amended by adding Section 42.0253 to read as follows:
1212 Sec. 42.0253. RELEASE AND INCLUSION OF EXTRATERRITORIAL
1313 JURISDICTION: CERTAIN AREAS. (a) This section applies only to an
1414 area that is located in:
1515 (1) the extraterritorial jurisdiction of a
1616 municipality; and
1717 (2) a county with a population of less than 75,000 that
1818 is adjacent to three counties with populations of more than
1919 450,000.
2020 (b) A majority of the registered voters in an area subject
2121 to this section may petition the municipality to release the area
2222 from the municipality's extraterritorial jurisdiction. The
2323 petition must be filed with the secretary or clerk of the
2424 municipality.
2525 (c) Not later than the 10th day after the date the secretary
2626 or clerk receives a petition under Subsection (b), the secretary or
2727 clerk shall determine whether the petition is valid. If the
2828 petition is determined valid, the governing body of the
2929 municipality shall immediately enter in the minutes or records of
3030 the municipality an order releasing the area from the
3131 municipality's extraterritorial jurisdiction.
3232 (d) An area released under Subsection (c) becomes an
3333 unincorporated area of the county. A municipality may include the
3434 area in the municipality's extraterritorial jurisdiction if:
3535 (1) the municipality is otherwise eligible to include
3636 the area in its extraterritorial jurisdiction under this chapter;
3737 and
3838 (2) the municipality receives a petition signed by a
3939 majority of the registered voters of the area requesting inclusion.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2023.
