10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 143A, Civil Practice and Remedies Code, |

12 | 12 | | is amended by adding Section 143A.0035 to read as follows: |

13 | 13 | | Sec. 143A.0035. VENUE AND CHOICE OF LAW. Notwithstanding |
---|
14 | 14 | | any other law, any contract, or any venue, forum selection, or |
---|
15 | 15 | | choice-of-law provision in a contract, an action brought under this |
---|
16 | 16 | | chapter against a social media platform shall be brought and |
---|
17 | 17 | | maintained in a court in this state, and the law of this state |
---|
18 | 18 | | applies to the action. |

19 | 19 | | SECTION 2. Section 143A.0035, Civil Practice and Remedies |
---|
20 | 20 | | Code, as added by this Act, applies only to an action filed on or |
---|
21 | 21 | | after the effective date of this Act. |
---|
22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
