55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to statutory damages in actions brought by social media
88 users against social media platforms for prohibited censorship.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 143A.007, Civil Practice and Remedies
1111 Code, is amended by amending Subsection (b) and adding Subsection
1212 (f) to read as follows:
1313 (b) If the user proves that the social media platform
1414 violated this chapter with respect to the user, the user is entitled
1515 to recover:
1616 (1) declaratory relief under Chapter 37, including
1717 costs and reasonable and necessary attorney's fees under Section
1818 37.009; [and]
1919 (2) injunctive relief; and
2020 (3) statutory damages in an amount that is not less
2121 than $750 and not more than $30,000 for each violation.
2222 (f) Sections 41.003 and 41.004 do not apply to an action
2323 brought under this section.
2424 SECTION 2. Section 143A.007, Civil Practice and Remedies
2525 Code, as amended by this Act, applies only to a cause of action that
2626 accrues on or after the effective date of this Act. A cause of
2727 action that accrued before the effective date of this Act is
2828 governed by the law as it existed immediately before the effective
2929 date of this Act, and that law is continued in effect for that
3030 purpose.
3131 SECTION 3. This Act takes effect September 1, 2023.
