| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 143A.007, Civil Practice and Remedies |
|---|
| 11 | 11 | | Code, is amended by amending Subsection (b) and adding Subsection |
|---|
| 12 | 12 | | (f) to read as follows: |
|---|
| 13 | 13 | | (b) If the user proves that the social media platform |
|---|
| 14 | 14 | | violated this chapter with respect to the user, the user is entitled |
|---|
| 15 | 15 | | to recover: |
|---|
| 16 | 16 | | (1) declaratory relief under Chapter 37, including |
|---|
| 17 | 17 | | costs and reasonable and necessary attorney's fees under Section |
|---|
| 18 | 18 | | 37.009; [and] |
|---|
| 19 | 19 | | (2) injunctive relief; and |
|---|
| 20 | 20 | | (3) statutory damages in an amount that is not less |
|---|
| 21 | 21 | | than $750 and not more than $30,000 for each violation. |
|---|
| 22 | 22 | | (f) Sections 41.003 and 41.004 do not apply to an action |
|---|
| 23 | 23 | | brought under this section. |
|---|
| 24 | 24 | | SECTION 2. Section 143A.007, Civil Practice and Remedies |
|---|
| 25 | 25 | | Code, as amended by this Act, applies only to a cause of action that |
|---|
| 26 | 26 | | accrues on or after the effective date of this Act. A cause of |
|---|
| 27 | 27 | | action that accrued before the effective date of this Act is |
|---|
| 28 | 28 | | governed by the law as it existed immediately before the effective |
|---|
| 29 | 29 | | date of this Act, and that law is continued in effect for that |
|---|
| 30 | 30 | | purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
