| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter I, Chapter 92, Property Code, is |
|---|
| 11 | 11 | | amended by adding Section 92.3516 to read as follows: |

| 12 | 12 | | Sec. 92.3516. WAIVER OF RENTAL APPLICATION FEES FOR CERTAIN |
|---|
| 13 | 13 | | PERSONS. (a) In this section, "homeless person" has the meaning |
|---|
| 14 | 14 | | assigned by 42 U.S.C. Section 11302. |
|---|
| 15 | 15 | | (b) A landlord or a landlord's agent may not charge an |
|---|
| 16 | 16 | | application fee to any homeless person in order to apply to lease a |
|---|
| 17 | 17 | | dwelling if the person provides acceptable proof of the person's |
|---|
| 18 | 18 | | homelessness, as prescribed by the Texas Department of Housing and |
|---|
| 19 | 19 | | Community Affairs by rule. |
|---|
| 20 | 20 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 21 | 21 | | of this Act and not later than January 1, 2024, the Texas Department |
|---|
| 22 | 22 | | of Housing and Community Affairs shall adopt rules necessary to |
|---|
| 23 | 23 | | implement Section 92.3516, Property Code, as added by this Act. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
