1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to combating human trafficking by the Texas Department of
1313 Licensing and Regulation.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 51, Occupations Code, is amended by
1616 adding Subchapter K to read as follows:
1717 SUBCHAPTER K. COMBATING HUMAN TRAFFICKING
1818 Sec. 51.551. ANTI-TRAFFICKING ACTIVITIES. The department
1919 may combat human trafficking by:
2020 (1) establishing within the department an
2121 anti-trafficking unit;
2222 (2) identifying businesses operating within
2323 industries regulated by the department that are impacted by human
2424 trafficking; and
2525 (3) coordinating with:
2626 (A) the office of the attorney general, including
2727 any council, task force, or work group established by that office to
2828 combat human trafficking;
2929 (B) local, state, and federal law enforcement
3030 agencies; and
3131 (C) any nongovernmental entity engaged in
3232 efforts to combat human trafficking or assist victims.
3333 Sec. 51.552. RULES. The commission may adopt rules to
3434 combat human trafficking for any program regulated by the
3535 department, including rules for conducting inspections and
3636 investigations under Section 51.351.
3737 Sec. 51.553. CONFIDENTIALITY OF RECORDS IDENTIFYING
3838 VICTIMS OF HUMAN TRAFFICKING. (a) Information that identifies an
3939 individual as a victim of human trafficking is confidential and
4040 excepted from disclosure under Section 552.021, Government Code.
4141 (b) The department may withhold the information without the
4242 necessity of requesting a decision from the attorney general under
4343 Subchapter G, Chapter 552, Government Code.
4444 SECTION 2. This Act takes effect September 1, 2023.
