13 | 13 | | Licensing and Regulation. |

14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Chapter 51, Occupations Code, is amended by |
---|
16 | 16 | | adding Subchapter K to read as follows: |
---|
17 | 17 | | SUBCHAPTER K. COMBATING HUMAN TRAFFICKING |
---|
18 | 18 | | Sec. 51.551. ANTI-TRAFFICKING ACTIVITIES. The department |
---|
19 | 19 | | may combat human trafficking by: |
---|
20 | 20 | | (1) establishing within the department an |
---|
21 | 21 | | anti-trafficking unit; |
---|
22 | 22 | | (2) identifying businesses operating within |
---|
23 | 23 | | industries regulated by the department that are impacted by human |
---|
24 | 24 | | trafficking; and |
---|
25 | 25 | | (3) coordinating with: |
---|
26 | 26 | | (A) the office of the attorney general, including |
---|
27 | 27 | | any council, task force, or work group established by that office to |
---|
28 | 28 | | combat human trafficking; |
---|
29 | 29 | | (B) local, state, and federal law enforcement |
---|
30 | 30 | | agencies; and |
---|
31 | 31 | | (C) any nongovernmental entity engaged in |
---|
32 | 32 | | efforts to combat human trafficking or assist victims. |
---|
33 | 33 | | Sec. 51.552. RULES. The commission may adopt rules to |
---|
34 | 34 | | combat human trafficking for any program regulated by the |
---|
35 | 35 | | department, including rules for conducting inspections and |
---|
36 | 36 | | investigations under Section 51.351. |
---|
37 | 37 | | Sec. 51.553. CONFIDENTIALITY OF RECORDS IDENTIFYING |
---|
38 | 38 | | VICTIMS OF HUMAN TRAFFICKING. (a) Information that identifies an |
---|
39 | 39 | | individual as a victim of human trafficking is confidential and |
---|
40 | 40 | | excepted from disclosure under Section 552.021, Government Code. |
---|
41 | 41 | | (b) The department may withhold the information without the |
---|
42 | 42 | | necessity of requesting a decision from the attorney general under |
---|
43 | 43 | | Subchapter G, Chapter 552, Government Code. |
---|
44 | 44 | | SECTION 2. This Act takes effect September 1, 2023. |
