| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 411, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter K-2 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER K-2. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS |
|---|
| 13 | 13 | | Sec. 411.321. DYNAMIC MESSAGE SIGNS. (a) Except as |
|---|
| 14 | 14 | | provided by Subsection (c), the Texas Department of Transportation |
|---|
| 15 | 15 | | shall provide information necessary for statewide alert systems |
|---|
| 16 | 16 | | created under Subchapters K-1, L, L-1, M, P, P-1, and Q through a |
|---|
| 17 | 17 | | system of dynamic message signs that are: |
|---|
| 18 | 18 | | (1) located across the state; and |
|---|
| 19 | 19 | | (2) capable of displaying digital images useful in |
|---|
| 20 | 20 | | locating a missing individual. |
|---|
| 21 | 21 | | (b) The Texas Department of Transportation may enter into an |
|---|
| 22 | 22 | | agreement with a private entity to install or operate the dynamic |
|---|
| 23 | 23 | | message signs described by Subsection (a) and shall request |
|---|
| 24 | 24 | | permission from the United States Department of Transportation |
|---|
| 25 | 25 | | Federal Highway Administration to implement this section. An |
|---|
| 26 | 26 | | agreement under this subsection must generate net revenue to the |
|---|
| 27 | 27 | | state and reduce the amount of tax revenue necessary to fund the |
|---|
| 28 | 28 | | installation and operation of the dynamic message signs described |
|---|
| 29 | 29 | | by Subsection (a). The Texas Department of Transportation may |
|---|
| 30 | 30 | | accept gifts and grants of money, equipment, or other resources |
|---|
| 31 | 31 | | necessary to install and operate the dynamic message signs |
|---|
| 32 | 32 | | described by Subsection (a). |
|---|
| 33 | 33 | | (c) The Texas Department of Transportation is not required |
|---|
| 34 | 34 | | to comply with Subsection (a) if that department receives notice |
|---|
| 35 | 35 | | from the United States Department of Transportation Federal Highway |
|---|
| 36 | 36 | | Administration that the use of the dynamic message signs described |
|---|
| 37 | 37 | | by that subsection would result in the loss of federal highway |
|---|
| 38 | 38 | | funding or other punitive actions taken against this state due to |
|---|
| 39 | 39 | | noncompliance with federal laws, regulations, or policies. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2023. |
