66 AN ACT
77 relating to dynamic message signs used in certain statewide alert
88 systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 411, Government Code, is amended by
1111 adding Subchapter K-2 to read as follows:
1212 SUBCHAPTER K-2. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS
1313 Sec. 411.321. DYNAMIC MESSAGE SIGNS. (a) Except as
1414 provided by Subsection (c), the Texas Department of Transportation
1515 shall provide information necessary for statewide alert systems
1616 created under Subchapters K-1, L, L-1, M, P, P-1, and Q through a
1717 system of dynamic message signs that are:
1818 (1) located across the state; and
1919 (2) capable of displaying digital images useful in
2020 locating a missing individual.
2121 (b) The Texas Department of Transportation may enter into an
2222 agreement with a private entity to install or operate the dynamic
2323 message signs described by Subsection (a) and shall request
2424 permission from the United States Department of Transportation
2525 Federal Highway Administration to implement this section. An
2626 agreement under this subsection must generate net revenue to the
2727 state and reduce the amount of tax revenue necessary to fund the
2828 installation and operation of the dynamic message signs described
2929 by Subsection (a). The Texas Department of Transportation may
3030 accept gifts and grants of money, equipment, or other resources
3131 necessary to install and operate the dynamic message signs
3232 described by Subsection (a).
3333 (c) The Texas Department of Transportation is not required
3434 to comply with Subsection (a) if that department receives notice
3535 from the United States Department of Transportation Federal Highway
3636 Administration that the use of the dynamic message signs described
3737 by that subsection would result in the loss of federal highway
3838 funding or other punitive actions taken against this state due to
3939 noncompliance with federal laws, regulations, or policies.
4040 SECTION 2. This Act takes effect September 1, 2023.
