| 7 | 7 | | relating to requiring a public school to certify compliance with |

| 8 | 8 | | the requirements to discharge or refuse to employ certain |
|---|
| 9 | 9 | | ineligible persons and to report certain educator misconduct. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 22.092, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (b-1) to read as follows: |
|---|
| 13 | 13 | | (b-1) Each school year, the superintendent of a school |
|---|
| 14 | 14 | | district or chief operating officer of an open-enrollment charter |
|---|
| 15 | 15 | | school shall certify to the commissioner that the district or |
|---|
| 16 | 16 | | school has complied with Subsection (b). |

| 17 | 17 | | SECTION 2. Section 22.093, Education Code, is amended by |
|---|
| 18 | 18 | | adding Subsection (k-1) to read as follows: |
|---|
| 19 | 19 | | (k-1) Each school year, the superintendent of a school |
|---|
| 20 | 20 | | district or chief operating officer of an open-enrollment charter |
|---|
| 21 | 21 | | school shall certify to the commissioner that the district or |
|---|
| 22 | 22 | | school has complied with the requirement to report misconduct under |
|---|
| 23 | 23 | | this section. |

| 24 | 24 | | SECTION 3. This Act applies beginning with the 2023-2024 |
|---|
| 25 | 25 | | school year. |
|---|
| 26 | 26 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
