55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring a public school to certify compliance with
88 the requirements to discharge or refuse to employ certain
99 ineligible persons and to report certain educator misconduct.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 22.092, Education Code, is amended by
1212 adding Subsection (b-1) to read as follows:
1313 (b-1) Each school year, the superintendent of a school
1414 district or chief operating officer of an open-enrollment charter
1515 school shall certify to the commissioner that the district or
1616 school has complied with Subsection (b).
1717 SECTION 2. Section 22.093, Education Code, is amended by
1818 adding Subsection (k-1) to read as follows:
1919 (k-1) Each school year, the superintendent of a school
2020 district or chief operating officer of an open-enrollment charter
2121 school shall certify to the commissioner that the district or
2222 school has complied with the requirement to report misconduct under
2323 this section.
2424 SECTION 3. This Act applies beginning with the 2023-2024
2525 school year.
2626 SECTION 4. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2023.
