7	7	relating to the secretary of state posting on the secretary of
8	8	state's Internet website databases containing certain information
9	9	about elections.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 4.003, Election Code, is amended by
12	12	amending Subsection (e) and adding Subsection (e-1) to read as
13	13	follows:
14	14	(e) The authority responsible for giving notice of the
15	15	election shall deliver:
16	16	(1) to the secretary of state a copy of the notice of a
17	17	consolidated precinct required by Subsection (b) not later than the
18	18	date of the election; and
19	19	(2) in January of each year information on an election
20	20	for a partisan office, the office of mayor, or a position on the
21	21	governing body of a city or board of trustees of an independent
22	22	school district for the secretary of state's database of election
23	23	information under Section 31.017 in an electronic format as
24	24	follows:
25	25	(A) if the authority is a county or political
26	26	party, as required by the secretary of state; or
27	27	(B) if the authority is a city or school
28	28	district, to the county in which the authority is located.
29	29	(e-1) A county receiving information under Subsection
30	30	(e)(2)(B) shall forward the information to the secretary of state.
31	31	SECTION 2. Subchapter A, Chapter 31, Election Code, is
32	32	amended by adding Sections 31.017 and 31.018 to read as follows:
33	33	Sec. 31.017. INTERNET DATABASE OF ELECTION INFORMATION.
34	34	(a) The secretary of state shall post on the secretary of state's
35	35	public Internet website a database containing information on each
36	36	election for a partisan office, the office of mayor, or a position
37	37	on the governing body of a city or board of trustees of an
38	38	independent school district provided under Sections 4.003(e) and
39	39	(e-1). The database must include the following information:
40	40	(1) the name of the authority;
41	41	(2) each office to be filled at the election;
42	42	(3) whether the office is elected at large or by
43	43	district;
44	44	(4) the duration of the term of office; and
45	45	(5) the dates of the preceding and next election for
46	46	the office.
47	47	(b) The secretary of state shall adopt rules as necessary to
48	48	implement this section.
49	49	Sec. 31.018. INTERNET DATABASE FOR INCUMBENTS AND
50	50	CANDIDATES. (a) The secretary of state shall post on the secretary
51	51	of state's public Internet website a database containing
52	52	information about each holder of and candidate for any partisan
53	53	elected office, office of mayor, or position on the governing body
54	54	of a city or a board of trustees of an independent school district
55	55	in this state.
56	56	(b) The database must include the following information
57	57	about a holder of a partisan elected office, the office of mayor, or
58	58	a position on the governing body of a city or board of trustees of an
59	59	independent school district:
60	60	(1) name;
61	61	(2) office title, including any district, place, or
62	62	position and a notation that the person is an incumbent;
63	63	(3) if the office is elected at large or by district;
64	64	(4) date of the previous and next election for the
65	65	office;
66	66	(5) public mailing address;
67	67	(6) public telephone number, if available; and
68	68	(7) public e-mail address, if available.
69	69	(c) The database must include the following information
70	70	about a candidate for a partisan elected office, the office of
71	71	mayor, or a position on the governing body of a city or board of
72	72	trustees of an independent school district:
73	73	(1) name;
74	74	(2) office sought, including any district, place, or
75	75	position;
76	76	(3) if the office is elected at large or by district;
77	77	(4) date of the election;
78	78	(5) public mailing address;
79	79	(6) public telephone number, if available;
80	80	(7) public e-mail address, if available; and
81	81	(8) if the candidate has filed as a write-in
82	82	candidate.
83	83	(d) The county with whom a declaration of candidacy is
84	84	filed, a state or county chair of a political party, or the
85	85	presiding officer of a political party's convention shall provide
86	86	information about a candidate or officeholder to the secretary of
87	87	state. A political subdivision shall provide information about a
88	88	candidate or officeholder to the county in which the political
89	89	subdivision is located and the county shall forward that
90	90	information to the secretary of state.
91	91	(e) The secretary of state shall make the name, office, and
92	92	party affiliation of the holder of a partisan elected office, the
93	93	office of mayor, or a position on the governing body of a city or
94	94	board of trustees of an independent school district available on
95	95	the secretary of state's public Internet website for as long as the
96	96	person holds that office.
97	97	(f) The secretary of state shall adopt rules as necessary to
98	98	implement this section.
99	99	SECTION 3. Section 141.032, Election Code, is amended by
100	100	adding Subsection (h) to read as follows:
101	101	(h) A county or political party with whom an application is
102	102	filed shall provide the secretary of state with the candidate's
103	103	information required for the secretary of state's public Internet
104	104	website under Section 31.018. A political subdivision with whom an
105	105	application is filed shall provide the candidate's information to
106	106	the county in which the political subdivision is located, and the
107	107	county shall forward the candidate's information to the secretary
108	108	of state.
109	109	SECTION 4. This Act takes effect January 1, 2025.
