55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the secretary of state posting on the secretary of
88 state's Internet website databases containing certain information
99 about elections.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 4.003, Election Code, is amended by
1212 amending Subsection (e) and adding Subsection (e-1) to read as
1313 follows:
1414 (e) The authority responsible for giving notice of the
1515 election shall deliver:
1616 (1) to the secretary of state a copy of the notice of a
1717 consolidated precinct required by Subsection (b) not later than the
1818 date of the election; and
1919 (2) in January of each year information on an election
2020 for a partisan office, the office of mayor, or a position on the
2121 governing body of a city or board of trustees of an independent
2222 school district for the secretary of state's database of election
2323 information under Section 31.017 in an electronic format as
2424 follows:
2525 (A) if the authority is a county or political
2626 party, as required by the secretary of state; or
2727 (B) if the authority is a city or school
2828 district, to the county in which the authority is located.
2929 (e-1) A county receiving information under Subsection
3030 (e)(2)(B) shall forward the information to the secretary of state.
3131 SECTION 2. Subchapter A, Chapter 31, Election Code, is
3232 amended by adding Sections 31.017 and 31.018 to read as follows:
3333 Sec. 31.017. INTERNET DATABASE OF ELECTION INFORMATION.
3434 (a) The secretary of state shall post on the secretary of state's
3535 public Internet website a database containing information on each
3636 election for a partisan office, the office of mayor, or a position
3737 on the governing body of a city or board of trustees of an
3838 independent school district provided under Sections 4.003(e) and
3939 (e-1). The database must include the following information:
4040 (1) the name of the authority;
4141 (2) each office to be filled at the election;
4242 (3) whether the office is elected at large or by
4343 district;
4444 (4) the duration of the term of office; and
4545 (5) the dates of the preceding and next election for
4646 the office.
4747 (b) The secretary of state shall adopt rules as necessary to
4848 implement this section.
4949 Sec. 31.018. INTERNET DATABASE FOR INCUMBENTS AND
5050 CANDIDATES. (a) The secretary of state shall post on the secretary
5151 of state's public Internet website a database containing
5252 information about each holder of and candidate for any partisan
5353 elected office, office of mayor, or position on the governing body
5454 of a city or a board of trustees of an independent school district
5555 in this state.
5656 (b) The database must include the following information
5757 about a holder of a partisan elected office, the office of mayor, or
5858 a position on the governing body of a city or board of trustees of an
5959 independent school district:
6060 (1) name;
6161 (2) office title, including any district, place, or
6262 position and a notation that the person is an incumbent;
6363 (3) if the office is elected at large or by district;
6464 (4) date of the previous and next election for the
6565 office;
6666 (5) public mailing address;
6767 (6) public telephone number, if available; and
6868 (7) public e-mail address, if available.
6969 (c) The database must include the following information
7070 about a candidate for a partisan elected office, the office of
7171 mayor, or a position on the governing body of a city or board of
7272 trustees of an independent school district:
7373 (1) name;
7474 (2) office sought, including any district, place, or
7575 position;
7676 (3) if the office is elected at large or by district;
7777 (4) date of the election;
7878 (5) public mailing address;
7979 (6) public telephone number, if available;
8080 (7) public e-mail address, if available; and
8181 (8) if the candidate has filed as a write-in
8282 candidate.
8383 (d) The county with whom a declaration of candidacy is
8484 filed, a state or county chair of a political party, or the
8585 presiding officer of a political party's convention shall provide
8686 information about a candidate or officeholder to the secretary of
8787 state. A political subdivision shall provide information about a
8888 candidate or officeholder to the county in which the political
8989 subdivision is located and the county shall forward that
9090 information to the secretary of state.
9191 (e) The secretary of state shall make the name, office, and
9292 party affiliation of the holder of a partisan elected office, the
9393 office of mayor, or a position on the governing body of a city or
9494 board of trustees of an independent school district available on
9595 the secretary of state's public Internet website for as long as the
9696 person holds that office.
9797 (f) The secretary of state shall adopt rules as necessary to
9898 implement this section.
9999 SECTION 3. Section 141.032, Election Code, is amended by
100100 adding Subsection (h) to read as follows:
101101 (h) A county or political party with whom an application is
102102 filed shall provide the secretary of state with the candidate's
103103 information required for the secretary of state's public Internet
104104 website under Section 31.018. A political subdivision with whom an
105105 application is filed shall provide the candidate's information to
106106 the county in which the political subdivision is located, and the
107107 county shall forward the candidate's information to the secretary
108108 of state.
109109 SECTION 4. This Act takes effect January 1, 2025.
