66 AN ACT
77 relating to the participation of campus-based mental health
88 professionals in certain managed care plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1451, Insurance Code, is amended by
1111 adding Subchapter L to read as follows:
1212 SUBCHAPTER L. ACCESS TO CAMPUS-BASED MENTAL HEALTH PROFESSIONALS
1313 Sec. 1451.551. DEFINITIONS. In this subchapter:
1414 (1) "Campus-based mental health professional" means a
1515 licensed clinical social worker, professional counselor,
1616 psychological associate, or psychologist who provides mental
1717 health care services primarily or exclusively at a campus of a
1818 school district or an open-enrollment charter school.
1919 (2) "Managed care plan" means a health benefit plan
2020 under which health care services are provided to enrollees through
2121 contracts with health care providers and that requires enrollees to
2222 use participating providers or that provides a different level of
2323 coverage for enrollees who use participating providers. The term
2424 includes a health benefit plan issued by:
2525 (A) a health maintenance organization;
2626 (B) a preferred provider benefit plan issuer; or
2727 (C) any other entity that issues a health benefit
2828 plan, including an insurance company.
2929 (3) "Open-enrollment charter school" means a school
3030 that has been granted a charter under Subchapter D, Chapter 12,
3131 Education Code.
3232 (4) "Participating provider" means a health care
3333 provider who has contracted with a health benefit plan issuer to
3434 provide services to enrollees.
3535 (5) "School district" means a public school district
3636 created under the laws of this state.
3737 Sec. 1451.552. USE OF CAMPUS-BASED MENTAL HEALTH
3838 PROFESSIONAL. A managed care plan may not deny participation of a
3939 campus-based mental health professional as a participating
4040 provider in the plan if the mental health professional meets the
4141 plan's credentialing requirements and agrees to the plan's
4242 contractual terms.
4343 SECTION 2. This Act takes effect September 1, 2023.
