| 7 | 7 | | relating to the participation of campus-based mental health |
|---|
| 8 | 8 | | professionals in certain managed care plans. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1451, Insurance Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter L to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER L. ACCESS TO CAMPUS-BASED MENTAL HEALTH PROFESSIONALS |
|---|
| 13 | 13 | | Sec. 1451.551. DEFINITIONS. In this subchapter: |
|---|
| 14 | 14 | | (1) "Campus-based mental health professional" means a |
|---|
| 15 | 15 | | licensed clinical social worker, professional counselor, |
|---|
| 16 | 16 | | psychological associate, or psychologist who provides mental |
|---|
| 17 | 17 | | health care services primarily or exclusively at a campus of a |
|---|
| 18 | 18 | | school district or an open-enrollment charter school. |
|---|
| 19 | 19 | | (2) "Managed care plan" means a health benefit plan |
|---|
| 20 | 20 | | under which health care services are provided to enrollees through |
|---|
| 21 | 21 | | contracts with health care providers and that requires enrollees to |
|---|
| 22 | 22 | | use participating providers or that provides a different level of |
|---|
| 23 | 23 | | coverage for enrollees who use participating providers. The term |
|---|
| 24 | 24 | | includes a health benefit plan issued by: |
|---|
| 25 | 25 | | (A) a health maintenance organization; |
|---|
| 26 | 26 | | (B) a preferred provider benefit plan issuer; or |
|---|
| 27 | 27 | | (C) any other entity that issues a health benefit |
|---|
| 28 | 28 | | plan, including an insurance company. |
|---|
| 29 | 29 | | (3) "Open-enrollment charter school" means a school |
|---|
| 30 | 30 | | that has been granted a charter under Subchapter D, Chapter 12, |
|---|
| 31 | 31 | | Education Code. |
|---|
| 32 | 32 | | (4) "Participating provider" means a health care |
|---|
| 33 | 33 | | provider who has contracted with a health benefit plan issuer to |
|---|
| 34 | 34 | | provide services to enrollees. |
|---|
| 35 | 35 | | (5) "School district" means a public school district |
|---|
| 36 | 36 | | created under the laws of this state. |
|---|
| 37 | 37 | | Sec. 1451.552. USE OF CAMPUS-BASED MENTAL HEALTH |
|---|
| 38 | 38 | | PROFESSIONAL. A managed care plan may not deny participation of a |
|---|
| 39 | 39 | | campus-based mental health professional as a participating |
|---|
| 40 | 40 | | provider in the plan if the mental health professional meets the |
|---|
| 41 | 41 | | plan's credentialing requirements and agrees to the plan's |
|---|
| 42 | 42 | | contractual terms. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2023. |
